Visa revoked , help

Hi everyone,

I am a student of a university of San Francisco, I'm doing my masters in computer science. I was on a vacation to India this summer i.e. A month back and while going back to United States , on the board of entry of San Francisco my visa was revoked and they gave me ban of 5 years under section 212(a) 7(a)I (i). I have my final semester left and I want to go back to complete my masters. Why do I need to do?

It was an f1 visa. I was working on that visa while studying.

How were you working? On OPT, or on the side while studying? You are not allowed to work on an F1 except in very specific circumstances.

That might be the reason your visa got revoked.

I doubt you will be able to get a waiver. If they gave you 5 year ban, as bad as it sounds, all you can do is wait? And then try applying for a new visa depending on your status and situation/intent.

They - officers at the border? If they told you that then you got your answer. Try applying for waiver and see what happens. Best of luck

You can always try for another F1, with a waiver.

From practical point of view look for somewhere local where you can finish your studies.

Get a lawyer pronto. One that is well versed in these cases.

This is not going to be a quick fix. You are most likely going to miss your final semester (fall, right?).

IF you can file a waiver then try for it, But nothing is guaranteed so be prepared for a denial and having to wait out the ban just in case.

As far as I know, officers at the border often give wrong information for the purpose of calming you down (have read stories here from people to whom it happened), but I don't think it would hurt to try.

It's not just a waiver you need to apply for...you do need a waiver of the 5 year ban. But, all that does is give you the ability to apply for a new F1 visa. During the visa interview, you will have to explain how/why you were working illegally in the US and how you can now support your studies without doing so again. Plus, you will have to demonstrate your intent to abide by all US immigration laws that apply to your visa category -- which include not working without authorization and intending to leave the US at the end of your authorized stay. I suspect even if the waiver is approved allowing you to apply for a new visa you will have an uphill battle convincing the visa officer that you can afford to finish you studies and you have no intent of working in the US without authorization.
