    Not really.
    I dont think this forum would exist if lawyers did their job and kept updated on USCIS's ever changing policies. Instead they play golf and drive beamers.
    USCIS changed their signature policy in Feb 2018. Easily Googleable by common peasants such as us.

    There IS a public charge rule. It's why sponsors have to file affidavits of support and make 150% of the poverty line for their household size. What do you think that's for? Fun?
     
    The proposed new rule is designed to make that qualification nearly impossible to PROVE—a lawyer I spoke to recently described it as requiring "a financial colonoscopy" and a far more extensive investigation than the existing documentation. And thus more difficult to overcome. It is a targeted act of discrimination to cut family-based immigration, which the bigoted administration otherwise has less leverage over than other forms of immigration. I'm a US citizen, by the way, and I am not affected by this rule. 
     
    Apart from all of that, by the way, I don't believe there should be a public charge rule at all. If immigrants pay taxes, they should be able to access public services. Our public services are such a disaster that I can't imagine anyone willfully relying on them if they didn't have to. The idea that people immigrating are pernicious freeloaders is preposterous. Do you think everyone besides you is trying to spend loads of money and time immigrating just to cheat and live the cushy life of SNAP benefits and Medicaid? 
     
    Try to access common sense, generosity and compassion simultaneously. It would change your life.

    Many people feel this way. But the polices are what they are. The only explanation I can give you as to why this is allowed (which you may not agree with but I am putting it out there anyway for you to consider) is that child support is not being considered as money to use to support the immigrant specifically but as money used to support the household overall. If you have 2 kids that makes your household size 4 you need to show you can support 4 people. If you have 3 kids then you need to show you can support 5. Youd have more child support with 3 kids then 2- so their child support is covering the childs share of household expenses. In most cases the parent receiving the support would argue its not even enough to cover the full amount of the childs expenses itself but rather just a portion of it.

    2. Does your Husband have income/assets to add?
     
    3. This has been mentioned but I will say again that the minimum requirement is just that, the totality of circumstances is often looked at and using what may have been considered dubious sources just to scrape by may be the issue.

    I’m extremely surprised they permit you to use child support (paid to you, to support your children), to be counted as finances available to support your new spouse.. 
     
    if I was paying child support and found out the money provided to care for my kids was being used for something like that, I’d be seriously annoyed and seek legal advise to prevent it..

    Well the first thing that stands out to me is only showing 6 months of statements for the assets. Generally you need to show 1 year or more. So theres that... There are also 2 types of disability payments you can get, one is standard SSDI and the other is SSI. I am assuming you are getting standard SSDI and not the SSI (supplemental security income). If so regular SSDI will count and they know its not taxable and still will count as income even though its displayed on a different line on the return/transcript. 
     
    it seems you have 25k in some type of retirement/pension income (taxable) and then maybe 10k in SSDI and then 5 in child support?  The retirement income + SSDI will definitely count. The child support can technically count but they can use discretion in considering it overall because unlike your pension or disability it will stop when the children become of age (which can be sooner the the shortest time the aff of support can be in effect for). But the child support amount based on the figures I am using is really a minimal amount and shouldnt make that much of a difference if its not considered. 
     
    For a spouse you need to show 3x in assets so 100k should make up for apx 33k deficit. I believe the issue is probably not sending in a years worth of proof of the assets.

    Hmm.....this is getting a bit beyond my knowledge base.  I don't know a lot about SSDI.  Are any of your kids close to aging out of the child support agreement?
     
    Let's see if @Boiler, @SusieQQQ, @geowrian, @aaron2020 or @Villanelle may have insights.

    I'm sorry you're going through this. I've been apart from my wife for more than a year now, and it's insanely painful too, I think about hugging her and I always find myself in tears, so I can empathize with your situation. The uncertainty of it all if really hard as well.  A lot of us in here go through the same, and I think we all understand your pain. I hope you can be reunited with your family soon. Stay strong friend.

    Looking at your timeline, it seems that you are waiting for your AOS interview and have already submitted a I-864. You could prepare another one, if the financial requirements issue comes up at the interview, you could present your amended I-864.  Otherwise, if you already meet the financial requirements, there is likely no need to bring up the subject.

    I don't see you having a problem, as long as your income meets the 125% guidelines.  
     
    Go the SSA website, login, then print out your benefits letter .. that is your evidence of income.    It is accepted income  .. and like said, not taxable.    You may want to write a letter explaining why you don't have a tax return;  that your income is not taxable

    I'm not sure I understand how this applies. I have read the USCIS website and SSDI is not listed at a public charge.  Is there a new change where it is?
     
    SSDI is not a welfare program like SSI, Medicaid, etc.

    I don't know what you're reading online but it is not true that you won't qualify for or can't use Obamacare. It is legal for immigrants to use. You just need to have proof of legal status because it is government paperwork afterall. That legal status is going to be your AOS NOA1, an EAD, or green card - whichever is the fastest to arrive in your hands (which is always going to be the NOA1). It is also not illegal or against the law to go without health insurance, but it isn't necessarily the wisest thing to be doing for your own peace of mind and safety. Massachusetts was one of the forerunners in developing a type of health insurance exchange program. If your state has an exchange then you must look there first, before looking at the federal exchange. Can I say you'll find anything cheaper than paying for it privately? It's possible. It's also not possible. Very few will qualify for the tax credit reduction, but that doesn't matter as it is also not a means tested benefit, and nothing illegal about it.
     
    Insurance works on tiers - silver, gold, and plat. Lower tiers for cheaper premiums will have greater cost in the form of deductibles and copays before you reach your maximum and the insurance picks up the full tab. Higher tiers will be more expensive in upfront premium cost, but you will have little to no deductible, rendering any cost of care cheap to non-existing.
     
     
    How does a person know when they are going to 100% going to die? My dad was laying on the floor flailing and staring in outer-space repeating ''I'm fine! what's wrong with everyone?!" while the paramedics worked to save his life and load him into a helicopter where he spent weeks in the ICU. In my case, when I without insurance I held out seeking treatment for a week and told myself I was fine and just a stomach bug. It was not. If I had waited any longer I'd have been dead. Before that time I had previously been completely healthy. The fact is you never know what is going to happen to you in your life. If you want to gamble with it that's fine, but everyone needs to seriously consider the value of their lives and their families before gambling themselves.
     
    My husband and I are not rich by any means. We have bills and a student loan to pay, and still manage to put food on the table and pay for our share of insurance. The company takes good care of us by what they pay out and we are thankful to them. Medicare is also not a golden ticket to freedom of healthcare for the elderly. It works and provides them security when they need it. But they still have their own premiums to pay, which when on a fixed SSI can be very difficult.

    We have our AOS interview coming up and we never took a copy of the I-485 package before we sent it?! In the checklist for the interview it says this is required, does anyone know what happens if you don't have this for the interview?

    AOS is mostly about income, don't worry on the photos together.   At the interview, if you are interviewed, they will ask a few questions about where you live, how many bedrooms, bathrooms and such ... general stuff.
     
    Living as a married couple evidence doesn't happen until 2 years after your conditional green card, at that time you will file ROC ... THIS is where you want lots of evidence (as in 24mos worth) of co-mingling of everything

    🤔 is European professional women any higher than other nationality women that they should be treated differently at immigration ..Didn’t know that ... & I’m glad you had antibacterial spray as every one else in the secondary line was carrying some sort of bugs as they were not European
