    You cannot expedite a B, you can apply for an emergency appointment and go from there.
     
    I assume the father is in AP and there is nothing you can do about that.
     
    Best bet is for the mother to travel.

    Wrong...sponsor is responsible indefinitely....this 10 year thing I see on here all the time is just wrong. It is only 10 years if they are working a job to earn the needed SSA credits, or they become a citizen. Other than that, the sponsor is on the hook.
     
    From my I-864:
    When Will These Obligations End? Your obligations under a Form I-864 that you signed will end if the person who becomes a lawful permanent resident based on that affidavit:
    A. Becomes a U.S. citizen;
    B. Has worked, or can receive credit for, 40 quarters of coverage under the Social Security Act;
    C. No longer has lawful permanent resident has departed the United States;
    D. Is subject to removal, but applies for and obtains, in removal proceedings, a new grant of adjustment of status, based on a new affidavit of support, if one is required; or
    E. Dies.

    You are probably only a couple years from US citizenship....  Are you willing to give up all the time and money you have already spent in the US immigration system to this point?  It's a big decision. Once you obtain US citizenship, you will be free to travel freely.

    You have no case and zero chances at appeal . 

    DOS /consulate has played a hand you cannot beat , no matter what sophisticated arguments /stretchy case laws are put forth. 
    THEY KNOW  and they also banked that neither USCIS, BIA or Federal Courts can compel them to be nice . 
     
    Nice , for example would have been a straight out inadmissibility finding of fraud /misrep. With such a decision , you could have already filed the I-601 and at least have a small chance . 
     
    The decision to put her in 221 g and ask for a divorce she cannot produce is Quite Common in cases like yours. ..so is this particular scenario in many countries .
     
    You’re off track in your marriage jurisdiction thought..hope someone can shed light for you …I am sticking to the interesting bits 😂
     
    The attorneys who told you to file a waiver without an inadmissibility finding in hand ..simply do not have hands on experience …KEEP LOOKING and ask the right questions …but if any of them suggest you put money , waste time and effort on this case..RUN. 
     
    The only way I see to FORCE the Consulate to issue a fraud /inadmissibility finding is do a new I-130 admit the fraud and afile concurrent I-601 specifically for USCIS 
    A lot of discretionary power in their hand , and your wife’s double dose of misrep is not sympathetic..but worth a shot. 
     
    If you pass the new I-130 and I-601 , she has a shot at another consulate interview and they HAVE TO acknowledge the Fraud:misrep IN WRITING…and likely will
    be asked for another I-601.

    She has to establish she was free to marry when she married you having previously stated she was married before.
     
    Around and around in circles we go, the reality of the situation is that USCIS have to accept she lied.

    The onus is not on them and anyway they have two sworn statements.
     
    The B application does not ask where the marriage took place.

    POLYGAMOUS MARRIAGE NOT LEGALLY RECOGNIZED UNDER INA
    The beneficiary was interviewed by a Consular Officer. Based on her interview, the consular officer determined that:
    On the form I-130, the petitioner indicated the beneficiary was only married once, which was to him. The beneficiary also confirmed this during her interview. Petitioner and Beneficiary were married on July 12, 2021.
    However, according to the beneficiary's non-immigrant visas, filed on on June 18, 2018, and April 9, 2019, the beneficiary listed her spouse as B(replaced the name). During the visa interview, the beneficiary stated that her husband was financing her studies.

    It would be a moot point because you have no control over which service center your case goes to.

    Shocking how nothing has been done to fix our broken immigration system. 15-20 years to sponsor a sibling is unacceptable, total contradiction for many politicians that preach family values.

    They don't owe you anything until she has satisfied her debt to them. That's how it works.  Follow their appeal process as listed on the letter they sent.
    Page 8 doesn't apply unless he pays quarterly estimated taxes.

    You or your wife needs file for divorce. Then you need to write to USCIS asking to convert your case to divorce waiver. Include copy of your divorce filing or divorce decree. Better hire a lawyer to help you with this. I don't think you understand the complexity of this case.

    The US may not extend tourist visas, but I know other countries do. My mother spent 4 years on Canadian visitor status, extending online every 6 months whilst her PR app was processed.
     
    Perhaps it's just the usual problem of tone not being portrayed well in the typed word, but your responses are coming across as aggressive and rude to somebody that was simply trying to help. I wish you luck but I think I'm done here.

    If they do and see this, reach out to me. I want to work for them, but 6 figures. 
     
    This morning, I was thinking. USCIS should employ some of us here in VJ at hourly rate to revise applications and mark as deny/ approve. Cuts work for IO. This will be cheaper for them and also help them speed up processes. So, you just appear at interview and your decision was made months ago...with all questions to be asked. 
     
    1. You came on B-2?
    2. You were married to XXX
    3. Where's the divorce certificate? 
    4. You have children with XXX.
     
    Basically, we do all the hard work and all IO has to do is know where to go fish answers (from DHS system) but denial/ approval decision that we made still stands. 
     
    I will gladly take even $20/hour of my free time to work on cases. Of course, I have my main job.

    In my opinion, if your end goal is naturalization, I would file the N400 and get that clock ticking.  As @Scandi mentioned, you get a fair amount of notice for an interview.
     
    In the end though, it is up to you.
