afrocraft got a reaction from PRC Rabbit in New Healthcare Requirements for US Immigrants
Why all the exclusions? Surely if they're good enough for Americans, they're good enough for immigrants?

afrocraft got a reaction from narakthisud in USCIS Entered Wrong Date of Birth to Their System, Need Help!
The e-request makes sense to me. Because date of birth is a core identifying feature, I imagine only someone senior (director level) can make that change to your profile. I had a similar issue (with my date of admission to the US), and it took referral to a Service Center director to have that fixed. There will come a time, most likely when you are seeking naturalization, that this issue will have to be resolved. It would do you some good to show that you have made formal attempts to fix the error.

Send the letter. Make sure it's certified mail. It only costs a few bucks, but it sends a signal.
Every advise I've given is what I did personally. In fact, I was even more aggressive. First, I sent them a message every 2 weeks after my initial interview via the USCIS website (same message, copy & paste, with just the timelines changed). They responded by saying the Field Office would be notified. On Day 90 I sent them the letter. Certified mail. I also contacted my Congress rep, and began to prepare to file a lawsuit on Day 121. 2 weeks later I got a call from the USCIS officer. Case resolved.
The common error people make is to treat USCIS like a person. They're a bureaucracy, and they're swamped. If your case slips by for one reason or another, you could experience severe delays. It's not personal. You need to know the law/policy, and then force them to act when the law is on your side.

And on lawyer, beside the cost: Even if you end up suing, you must show the court that you've exhausted all your administrative options. You've contacted USCIS by phone; you've gone for InfoPass or it's not an option available in your field office; you've written to USCIS; you've tried going through your Congress rep/Ombudsman. Only then would you have good standing to sue.

It's been a while since I logged in, but from memory it should be on the upper right side when you click account or profile or something like that.

They're just blowing you off. And that agent is factually wrong about both the processing time (doesn't apply once the interview has happened) and the N-652 (it's not discretionary). Per the USCIS Policy Manual:
I have advised you on how to proceed in an earlier post. Ball is in your court.

afrocraft reacted to Zaidba in 2 year and one day rule? Should I file N400?
There is confusion about this rule. I have discussed it with several lawyers, some think it applies and others said it applies ONLY if you have been denied!
It does not make sense, but the wordings of the rule says that. Therefore, if you don't mind the application fees, it is worth a try, otherwise waiting one more year is safer. Good luck.

afrocraft reacted to Iamdown2019 in Received RFE. Can I leave the states now?
Quick update for anyone's got into the same situation: Do not panic like I did. I got my ceremony scheduled 1 month after I mailed the RFE respond. I officially became an American citizen on last Friday. I know it is stressful to go through process like this, but if you have a minor disorderly conduct ticket like I did, you will most likely end up just fine. IO(s) are humans too, and they understand we all make dumb mistakes.
I have gone through the whole thing without hiring an attorney and I still feel dumb about it today. If you have anything other than traffic tickets on your records, please, for the sake of not fighting this war alone, hire an attorney or at least have a consultation with them before you file the N-400. Because you know, when I got told that I needed to respond to the RFE, I felt hopeless and helpless. You don't deserve to go through all the fear and to fight alone.
Good luck, everyone!
Special thanks to: USS_Voyager and dilip for your kind words and keeping me up during the waiting. I have been superrrrrr happy since I got the ceremony letter.

Lol. You and Trump care that much about Mexican immigrants?

Really? It's about immigration restriction under the guise of "healthcare" and "self-sufficiency."
Nice try, though.

afrocraft got a reaction from AnonIndia in New Healthcare Requirements for US Immigrants
It's not. It's a laudable goal. But that's not the policy here. The policy is to bar immigrants from entry who cannot show ability to pay for health care like the rest of us do.

Look, we've seen this movie before. America prides itself as a nation of immigrants, but when the demographics of the immigrant change, sentiment towards immigration changes too. The waves of immigration of southern Europeans/Irish and of Asians in the last century and some saw similar backlash from the majority, and restrictive policies followed. Now it's mainly brown people from the South. This too, shall pass.

You can't see any middle ground between mean policies and open borders?

The point of the American experiment isn't that we're perfect: It's that we're constantly moving towards a more perfect Union. That the arc bends towards justice. That long-run trend will continue, despite short-term hiccups like the last 3 years. The sonnet holds.

You know better. We just let them live their lives. But we didn't ask them for a health policy at Ellis Island.

Anyway this news is just a smokescreen. No one with any serious knowledge about healthcare costs in America thinks that access by immigrants is a major cost driver. But because this administration won't go after excess profiteering by health insurers, drug & device makers, and other providers in health care, they want you to focus your ire instead on poor migrants "taking your health care away from you." From the discussion on this forum, that strategy appears to be working.

OK. That's problematic. You have no real proof of the decision, then. Who knows if you misheard the officer?
No worry, though. If I were you, I would write the Field Officer and ask for an update (check the USCIS website for the office mailing address, and send via certified mail). Ask for an update, recounting your application history (filing date, biometric date, interview date, and interview outcome, and no RFE). Say it's now gone past 90 days.
