So, your father is currently working without authorization. And you’re complaining because he won’t be able to work after his license expires even though he isn’t supposed to be working now?

    @w
you might want to have another look at your father’s I485. And have a chat to him about his SSN. His SSN might have been stolen, he might be using a fake SSN, his SSN might actually be an ITIN. Then make sure your father said he has worked in the US without authorization… the delayed issuance of the EAD might be because his gave incorrect information or it could be because EAD issuance is not consistent and you have nothing to worry about.
I hope your parents also know they cannot travel with AP or they will incur a ban. If you think your father was 💯 honest in his application for adjustment I would submit a request for expedite (I assume he has a job offer?)
    Good luck!
P.S as the petitioner it is your duty to look after your parents during AOS. You’ve signed documentation showing you can support them. And your mother can work to help you out seeing as your father is currently unable to work.

Yes, I know that. My dad has been doing his taxes for a long time now. And I understand your statement about USCIS not expediting my dad's case because he hasn't been working with proper work authorization. But to my dad's defense, he has always done things legally. He held a job as a janitor at a Chase bank, and I would think that they wouldn't hire him if they believed it was not legal but it seems to me that the requirements to work legally are wishy-washy.

All of this aside, I am just worried that he will not get his EAD in time and when I say I am worried, I am worried for his mental state. He will stress about this. That is all. I know every case is different and some cases get approved quicker than others.

@Boiler and @Crazy Cat are correct. SS alone does not grant work authorization, you have to have either an EAD, GC, work visa.

I doubt they will expedite a case where an applicant has been working without proper work authorization, i.e illegally.

A lot of people in this country hold jobs, pay taxes and they do that without work authorization.

'This was true for many years, including when I went through this back in 2014-15. Alas, K-1 visa applications became the black sheep at USCIS (I blame the show 90 day fiancee ) and the processing time is now similar to a spousal visa. Since the spousal visa includes a green card and the K-1 does not, the spousal visa is the better option now.

Does not make any sense. If a case is closed it is denied or approved.

Apply in person using Form DS-11 if you respond "Yes" to at least one of the following statements:
I am applying for my first U.S. passport. I am applying with my child who is under age 16. My previous U.S. passport was issued when I was under age 16. My previous U.S. passport was lost, stolen, or damaged. Will your financial concerns no longer be a problem in 12+ months?
    Be aware
1.) Once your partner comes to the US you will have to marry and they she needs to adjust status.
2.)The cost of adjustment is about to increase (over $2000).
3.) She will not be able to work until she receives her employment authorizations.
4.) Depending on the state you live in- she won't be able to drive until she receives her employment authorization.
~Currently work authorization is taking +/-8 months but the time could increase or decrease (we have some members waiting on permission to work for over a year).

Do not only think of the immediate short term issues you are facing. With immigration to the US, you have to plan for the next 24-48 months.

Registering to vote and voting are rights afforded only to citizens, meaning either one will be interpreted by USCIS as claiming to be a citizen.

Please consult with an attorney for your options going forward and do not apply for citizenship without one.

usmsbow reacted to Lemonslice in Have to legal birth certificate from two different countries
Not necessarily, some countries will not issue birth certificates to people born in some situations (undocumented/temporarily present/etc.).  Others, like me, have birth certificates from more than one country because it is how the registration of birth abroad is done for them.  It is not call "registration of birth abroad", just "birth certificate" - it gets weird.

@ymir it is not clear what you are trying to do exactly - listing the countries and providing more details might help other users guide you.

I'd wait and see what the notice says - it may just be a very poorly worded notice, indicating that the spouse has withdrawn themselves from it and the notice of that is in the mail.
Is the full notice in your online USCIS account for you to view?

To be clear, your soon to be ex spouse can withdraw themselves from a joint I-751. Ditto that you can remove them from a joint I-751, by switching to a divorce waiver as you intended to do.
They cannot withdraw the entire joint I-751 petition. That isn't legal, or policy, as it is a document with both of you as signatories, and you are the immigrant petitioner. It is, and remains, your petition primarily.

Note that this is nothing to do with the I-864 - they also cannot withdraw from that. The I-864 is binding, even when divorced, until you become a citizen, cease to be a permanent resident, or have accumulated a certain number of work quarters

People here focus on the immigration and visa side of CBP, per the nature of this website

The first letter of the acronym is Customs.  The people walking around baggage claim and watch arriving passengers collect their luggage and sometimes question them are also CBP.  A major portion of their work is to spot and investigate customs violations.

EDIT: Everyone is subject to the above, even citizens.
