Lucky2Lucky got a reaction from Chancy in American / Australian living in Thailand: K-1 or CR-1? Relocate to Mexico?
Hello and welcome! It would make most sense, in my opinion, to get married (anywhere) and apply for the CR1. Processing times are slower due to COVID and either visa will most likely take more than a year. There are some drawbacks of the k1 which I’m sure will be posted in more detail but are are that the immigrant can’t work or travel immediately after marriage. You would file a new petition to adjust status, work (EAD) and travel (AP) and that would take anywhere from 4-12 months. If money is an issue that is a more costly way as well. No one wants to spend time away from their fiancé/spouse but that is a reality during immigration. It makes sense to get married now since you are physically together. You mention Mexico- you wouldn’t be able to have your consulate interview in Mexico since partner wouldn’t have residency in Mexico- you can’t be in “tourist” status. You would have to establish domicile towards the latter part of the process which could mean some separation. It sounds as if hour job can continue as you work remotely which is great for the sponsorship piece. Make sure you have been filing taxes while abroad as well as this would be required to present. I honestly would try to get “fastest” out of your head- immigration requires a lot of patience. There is no fast and covid has significantly slowed things down. Good luck!

That should be false. You can put your wife on your insurance and you probably only have a 30 day time period after marriage to do it. Speak to HR management if you get push back. After your spouse gets her green card she would be so completely out of a qualifying life event that she would have to wait for open enrollment.

There are no immigration related issues with her being on a separate plan. If you chose to not do your own plan you can purchase her insurance on your states health exchange site within 30 days of immigrating- as that would be the qualifying life event for the health exchange.

You will be able to add your fiance to your insurance, once you marry. No waiting for the green card is required. She is eligible upon the marriage. Do not wait on this, as you have a limited timeframe, and you do not want to be stuck without. Green cards are taking an extremely long time now, absolutely don't wait.

Your other options would be to use the health exchange (federal or state if you have one), or buy a plan privately. Temporary insurances and 'new immigrant' coverage are not ACA compliant and offer very little in the way of pre-existing coverage.

You may be told that your wife requires an SSN to obtain health insurance. Commonly many HR reps and even phone reps for companies will erroneously or maliciously state such falsehoods. By law it is not required to have an SSN for insurance, however it will make obtaining it a lot less fuss. Typically once the K1 has been issued and the fiance enters the US, they can go to the SSA and file for an SSN before they marry (you can find threads on this on VJ).

    So what did we do?

    Got K1 and entered US.
Waited 2 weeks (this no longer applies anymore and you can apply asap as long as the fiance is in the system - check the I94).
Applied for SSN (remember the fiance IS eligible to apply, if the SSA employee gives you a problem ask for supervisor or apply at another branch).
Got married. SSN had arrived by that time.
Added husband to my insurance plan. They did not ask for an SSN. The law states that they can and may ask several times to provide it (they did ask eventually), but you do not have to give it out if you do not want to. This really is for IRS identifying purposes, and the only person who is truly authorized to obtain the number is the IRS directly.
    Applied for AOS with EAD.
Got EAD. Applied for first driver's license.
By this point the spouse may start working, so they may be able to obtain insurance from their own employer.
Once you have the green card, return to the SSA and update (remove restrictions) from the SSN. Update driver's license if applicable.

Yes, she can visit, subject to CBP inspection.  As mentioned above, no one can predict how CBP will decide at the point of entry.  To mitigate the risk of being turned away, she should bring evidence of her strong ties to Canada.  Also, I highly recommend going through an airport with CBP pre-clearance.

Check this thread for reports from other VJ members who visited their spouses in the US during their CR1 process --

I think you mean that your petition has been approved and your case, documentarily qualified (DQ).  Visa applications cannot be approved prior to interview.

To hear from other Canadians with cases also DQ, check this thread --

Trying to figure out why anyone would pay a third party site to give you information that may or may not be better than you can get elsewhere, but that in any case you have no control over and does not actually make a difference to you. Especially if it is not even accurate enough to make, for example, travel plans around.

But hey, if anyone has ideas for an app I can start that people will pay me for when I don’t have to do much effort on getting the info I pass on to them and am not held to account for its  accuracy … let me know! I like the business model as a seller !!

How would you like me to back that claim up? What -or whose- statistics would you actually believe? Because a quick google search can easily find those facts. I could tell you as a health care worker the deaths are in the unvaccinated but I bet you wouldn’t rely on my first hand knowledge either. I said deaths in the unvaccinated- not overall those who have covid. The vaccines do a pretty darn good job preventing deaths. I’d say that makes it effective at saving lives. The vaccine was never touted as “you will never ever get covid again”.  I’m surprised that well more than 50% of people in your state are the ones with covid, but I bet they aren’t the ones dying.

I don’t just believe anything- I look at facts - where do your “facts” come from? I never said 99% of covid cases are unvaccinated. I see you have a comprehension problem so I don’t think whatever data/statistics you look at would be interpreted accurately  🤷🏻‍♀️ And that pretty much just invalidates everything you say.

Yes, she can visit. No one can tell you definite if immigration will let her through. It doesn’t appear Canadians who have petitions pending are significantly scrutinized. Her travel history falls in her favor. Good luck.

My wife works in healthcare too. She tells me a vast majority of people she sees getting sick are vaccinated people. Think I'll rely on my wife's first hand knowledge over someone on an internet message board.

How about not believing anything and looking at the facts? I have yet to see any actual statistics showing 99% of covid cases are vaccinated people. In fact reports from other countries seem to suggest the opposite.

Agree its hard to know what to believe, but I would think the fact the vast vast majority of hospitalizations and ICU admits are unvaccinated proves the vaccine, although not 100% is having a big impact
