    Seems they already applied for the K1. But applying for the spousal now would not be THAT bad considering that with the fiancee visa, they would still need to pay for AOS, EAD, AP and very likely, ROC.
     
     
    The "risk" of being lectured and even being sent to secondary inspection is always there -AP or not-.
     
    I agree with @Dashinka: the main issue is not entering the US but boarding the plane back.
    Problem is that if people avoid traveling on AP, the airlines will never really get acquainted with the document.
     
    I am guessing that now it costs 630usd, there will be way less applications and it will be just for actual emergencies.

    It seems you are suggesting trying to deceive CBP when you enter by showing them proof of a job you no longer have and showing them a return ticket you plan to change.  This is not a good plan.

    Did you already know her before she entered the US? When did you meet her? Even if you met her the day she entered the US, discussing marriage (especially in her circumstances) seems VERY hasty..

    I can't answer the first part.
     
    I married my first wife in the U.S. in May of 2000.  My divorce was finalized in the U.S. in March of 2004.  (She was already back in Russia and to my knowledge never entered the country again.)  Even though I sent them a copy, INS/CIS (that's how long ago this was) still sat on the form another four years before sending me a note that my application was cancelled because we were no longer married.
     
    I married my second wife in April of 2011.  She got her naturalization in October of 2014.  
     
    The only time my first wife came up during my second wife's paperwork was for me to prove that my marriage had been properly ended by divorce.  I still had a copy of my first marriage license and I submitted both it and the divorce decree.
     
    If it was five days after you divorced the first wife, they might scrutinize it.  It sounds like your first marriage was terminated properly and you're not just marrying people for green cards.  I think you're okay.
     
    Again, I can't speak to the first part.

    Don’t touch the border, unless it’s the House bill and that the steaming pile of excrement that originated in the retirement home, aka the Senate.
     
    It may be low-down, dirty politics, but it’s one of the most effective policy arguments the GOP has against this admiration and it’s great grandparents in the Senate come November.

    I think you’re misunderstanding the requirements.   Individual consulates do not set their own medical requirements.

    It's not a matter of the Consulate or Embassy, but a requirement by USCIS in accordance with the CDC.

    That and the CBP carrier guide.  Sometimes you have to educate the airline clerks, and others.  This is somewhat off topic, but often prior to COVID my wife and I would route through Beijing when traveling to Central Russia, I don't know how many people I had to educate that neither her nor I needed a China visa since China allowed 24 hr visa free transit.

    Regardless of your plan, you can only stay for the duration CBP allows.  If an officer sees a return ticket for 2 weeks out, they could authorize your stay for only two weeks.  Also what do you do if CBP sends you to secondary and they want to review your social media posts?  You are not required to offer any information to CBP other than to answer their questions truthfully (purpose of visit along with who you plan to visit are fairly common questions), and you seem to have a plan on an open social media website planning to attempt a deception.  As I mentioned before, not a good plan.

    Yes, especially if you lose the card. When I had it I wasn't traveling for this reason alone. (I wasn't familiar with the land border option then.)

    The biggest challenge with the AP is dealing with airlines that are unfamiliar with the AP as proper documentation to enter the U.S. legally.

    Just on a side note, has there been any consideration of getting married and filing for a spousal visa, rather than a fiancé visa?  There are pros and cons to each, but a big pro these days is the spousal visa is significantly less expensive and would allow your partner to enter the US without restrictions on work and travel.

    You're looking at the short term game when you should be playing the long game. Lying to CBP will come back to bite you.  Maybe you get through the K1 process fine, but then you still have to adjust status AND remove conditions.  After that, naturalization.  At any time, your hopes and dreams could be dashed because you made an unintelligent decision to lie to CBP.  Is your fiancé ready to move to Malaysia if you mess this up and get caught?  
     
    Don't lie and don't do devious things.  Immigration is a PRIVILEGE, not a right.  There are rules for a reason and lying to CBP is doing yourself and your partner no favors.

    This is such a bad idea.  CBP are very well trained at detecting things like this. 
    What if they call your employer to verify your employment?
    What if they see you have a 2 week trip booked and they limit your trip to 2 weeks?  Then you must return home with no job?
     
    No one on here is going to condone or support your plan.  I suggest you plan a trip for 2 weeks, return to your home county, continue to work until you move to the U.S. on your K-1 visa.
