Even more interesting. I think your step-father can in fact just file an I485 for you in this case as there is no deadline for filing the AOS package from a K1 (not sure about K2, but I expect at 21 you would age out). I would recommend calling into Hacking's show asking the question if you can AOS from a K2 as a step-child after 17+ years? You may need to explain that your biological parent and step-father are no longer living together, but are still married. It may be since your bioparent did not AOS, you cannot as a K2, but you are still the step-child of a USC, that step relationship occurred prior to your 18th birthday, and you are in the US, so the I130/I485 option may be there. Good Luck!

This is an interesting situation. Since they did get married and you were a minor at the time, it seems possible that he could petition you as a step-child which may require both an I130 and I485, but I am not sure what the marriage ending (I assume there was a divorce) affects things. It might be worth looking into Jim Hacking on his YouTube show. In the end, a very complicated situation, and I agree with the others, a good immigration lawyer consult should occur. Good Luck!

Generally it is the consulate officer that determines if a beneficiary can file an I601 as the timeline @Boiler mentioned, it is not filed before the interview. So either the I601 is just tagging along with the I130, or it was separated by USCIS and they may simply deny it as they are not the entity that decides them. Good Luck!

After the over-turning of RvW, I would hope SCOTUS would also overturn Chevron. The Supreme Court May Be on the Brink of Radically Restricting Bureaucrats' Power The United States Constitution vests all legislative powers in Congress. Yet, over the past century, we've witnessed a disturbing trend of legislators increasingly delegating much of the authority to set the laws that govern the land to the executive branch, which includes unelected officials at administrative agencies. This undermines democratic accountability, contributes to government bloat and abuse of powers, and disrupts the balance of power crafted so carefully by the Framers. Reasserting congressional authority is essential for maintaining a balanced government and ensuring that policies reflect voters' wishes. It's also the best hope for promoting economic freedom and growth. Unfortunately, getting Congress to stop evading its authority is an uphill battle. After all, we're talking about an institution that systematically fails to do another of its primary jobs by passing legitimate budgets on a timely basis. Nevertheless, there is some light at the end of the tunnel, as the Supreme Court might soon stop being so deferential to executive branch agencies in interpreting the laws set by Congress. As I understand it, "Chevron deference" is a judicial doctrine created by the 1984 U.S. Supreme Court ruling Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc. This ruling compels courts to defer to a federal agency's interpretation of ambiguous language in statutes that the agency is tasked with administering. In theory, the deference allows agencies to implement complex statutes. In practice, it limits the judiciary's proper role in holding the other two branches of government responsible for carrying out and sticking to their constitutional duties. One result is too much discretionary power exercised by agencies who were envisioned to enforce, rather than create, the law. https://reason.com/2024/06/20/the-supreme-court-may-be-on-the-brink-of-radically-restricting-bureaucrats-power/

Is there anyway to become a citizen without the test?
Dashinka replied to TVC's topic in US Citizenship General Discussion
My wife was nervous as well considering English is not her first language, as well as learning the civics portion. We got the test book, and reviewed it constantly for about two months prior to her interview, and she was fine Also, review this post of one of our most senior member's experience with helping his wife with the civic questions. Good Luck! -
Colorado's Legal Pot Boom Goes Bust
Dashinka replied to TBoneTX's topic in Current Events and Hot Social Topics
I remember driving East on I70 right a year or so after CO legalized pot, and from the Utah border all the way to Denver, it seemed that every exit had a pot shop. I suspect the cartels are playing a role allowing people other outlets that may be cheaper, or some may be growing their own. -
New Immigration Policy

Yes. Those that entered without inspection (EWI) do not have the option to adjust. This just bypasses the entire visa process. -
How much do you pay for DC fast charging at a Tesla site? I have seen estimates at other non-Tesla DC chargers where the cost was on par or even higher than fuel. I am curious as to how things will change as more OEMs adopt the NACS plug, and if this will back up Tesla charging sites. I am also curious as to the move Tesla made to lay-off a large swath of their charging network staff. I have heard some were rehired, but not sure what the long-term plan will be. I always thought it was a great move for Tesla to build up their charging network, and to even allow free charging for the very early adopters even though this was obviously not sustainable which is why they are trying to get those cars off the road. I know what you mean about people with different habits when taking long trips. Some like to meander and take their time, some just want to get to their destination in the shortest time possible. EVs can be used, but the second group which would not be happy.

Undecided future voter - Please help?
Dashinka replied to Visitor User's topic in Current Events and Hot Social Topics
I heard him described as the UK version of Trump. I read an article the other day where at some semblance of a debate among all the parties there Farage was essentially an outsider as shown by how the other party deputy leaders treated him leading the article author to opine about the UK's uni-party. Does it really matter if the tories or the labour folks win? -

Is that Farage that leads the MRL Party? -
Tesla is actually the best of the EV makers (Fisker just filed for bankruptcy), but they do have one big problem, they seem to have paused any meaningful vehicle development. The 2024 Model 3 looks just like your 5 yr old vehicle, and is essentially the same, and the Model Y looks like the EV equivalent of the Pontiac Aztek. The CT is just awful, and the stainless steel panels can be quite dangerous. The S is the best styled EV sedan I have seen, but again, there have been little updates to it. These are all issues when companies are trying to jump the chasm from early adopters to the early majority which EVs have not done yet. We shall see how it all pans out, I am all for EVs for those that want them and are willing to pay the premium for them, but I am against any government subsidies for a consumer product that is essentially the same as other consumer products on the market, and I am not for believing EVs are emission free (VOCs are a major issue with EVs given all the plastics, adhesives, potting, thermal glue, etc. used in them even though government regulators ignore this pollution), or somehow a technological leap over current ICE equivalents. I regularly (3-4 times a year) take long trips (1,000 mile+), and I would never take an EV on those trips (even a Tesla). My wife and I share the driving and we take food with us instead of stopping at restaurants, so our stops are as short as possible. We just took a 1200 mile trip with 7 stops (3 for fuel and 4 more for restroom/driving swaps) and did it in 16 hrs (averaged 75 mph). If I did that in an EV, I would have added at least 6 stops of 20-60 minutes (depends on if I could find a DCFC), so worse case, a 16 hr trip would have taken 22 hrs which would have required spending money at a hotel. Again, EVs are a fine option, but from a functional standpoint, they have some big limitations.

Hmm, some recommend voting Democrat straight party. And it turns out this guy worked in the WH appointed by Old Corrupt Petulant Joe. Not surprising, Democrats are corrupt. Texas Dem charged with faking racist online attacks on self: 'Concerning' HOUSTON (TND) — Taral Patel, a Democratic Texas county commissioner candidate, is facing a felony charge after allegedly falsifying racist social media attacks against himself. While campaigning for Fort Bend County Precinct 3 commissioner in September, Patel issued a social media statement condemning several racist messages he allegedly received. The post included a collage of messages from Facebook users, some of which had their names censored. https://komonews.com/news/nation-world/texas-dem-charged-with-faking-racist-online-attacks-on-self-report-says-concerning-taral-patel-democrat-candidate-fort-bend-county-precinct-3-commissioner-andy-meyes-republican-politics-dps https://www.taralpateltx.com/about

Documents for 5 year naturalization rule ?
Dashinka replied to astroboy3545's topic in US Citizenship General Discussion
Yes Yes Not sure this is actually needed, but since you are doing it online, doesn't hurt to add it. For 4, I believe you choose "Return" when you can. I would also add evidence of termination of any previous marriages. Good Luck! -

I agree, base the dates off when you were physically living at the addresses, not on the lease paperwork. Good Luck!
