  6. No, you would have had to be a USC at the time of birth. Stay the course on the I130, but I believe after your daughter gets her visa and enters the US, she will become a USC automatically. Good Luck!
  7. You can change the current I751 to a divorce waiver, but keep in mind when you do that, you will get an RFE to provide the final divorce documents within 90 days. I would focus on completing the divorce, then submit the change to divorce waiver and provide the documents. Good Luck!
  8. You can start the process and if the I130 is approved and moves to NVC, you can let it simmer there indefinitely by accessing the case at least once a year. I do not think it would impact ESTA, but others may know better. Good Luck!
  9. Consular Report of Birth Abroad. You refer to her as your daughter, are you a biological parent? If yes, you may be able to pass on US citizenship to her through the CRBA process. If not, then you need to file the I130.

  15. Poor wording on the back of the card letter. If filing jointly, do not send the I751 in before the 90 day window opens or it will be rejected. The exception is if a person is filing an I751 with a divorce waiver, those can be submitted anytime. Good Luck!

  21. My wife traveled with a GC about to expire (still valid when she departed) and she had no issues. We filed the I751 in the proper filing window, and while she was away her GC expired, but she had her valid extension letter. I have never heard of an airline clerk doing anything related to six months validity, but when my wife was traveling with her extension letter, she did have an airline employee ask to keep it, luckily she had a copy to give her. You should have no issues traveling (and re-entering the US) on a valid GC regardless of how long before it expires. The CBP carrier guide does not mention anything related to a six month period, so take a copy of that with you.
