  1. She can try, but it will be a hard bar to overcome immigration intent with an I130 in process. A denial should not impact the spousal visa case unless she would materially misrepresent herself with a B2 interview or on the DS160. Good Luck!
  2. If they need additional information, or to do other work such as background checks, you could get a 221g and the color of that paper is meaningful. If the CO does not give you a 221g, then all you might get is a verbal approval, but even that is not final. What you need to look for is "Issued" in the online system. As to how long it takes to get the passport back with a visa, that is highly variable depending on the case and the consulate. Anywhere from a week or two to over a month or more. Good Luck!

  5. The K1 visa was used for an entry, so nothing needs to be done (K1 is single-entry, so when CBP endorsed it, the visa becomes invalidated for any other potential entry). You should be fine with moving to a spousal visa, don't worry about the previous K1. Good Luck!

Will giving Lebanon some $157 million in “extra” aid persuade the population to turn on Hezbollah that has stored some 150,000 rockets and missiles aimed at Israel in their midst? Did prior aid result in only 9,000 missiles being launched from Lebanon at Israel? Did the DEI mandates and advertising, the new woke protocols, and the vaccine expulsions all explain why the Pentagon was only 45,000 short in its targeted manpower recruitments? So please, Secretary Blinken, President Biden, a Vice President Harris, and candidate Walz, do not in the last weeks of the election gaslight us, the American people, that a world now in freefall and on the threshold of multiple theater-wide wars, all involving nuclear powers, is somehow a sign of a “stronger geopolitical position.”
  7. Stay safe. My brother and SIL were at their house in North Port, and they headed out Monday evening. It took them 12 hours to get to just South of Atlanta. It looks like the Ft. Myers to Sarasota area might get it directly.

  14. DIY O1's are quite rare here on VJ. Just a quick search only turned up a couple of examples the most recent being from 2019 (see below). The best advice is to look for a good immigration lawyer that specializes in O visas as much of the success depends on the way the evidence is packaged. Good Luck!
  15. Are you sure? Who would be the fallback? Hillary? Btw, I think the horse has left the barn, regardless of the number of states with a Democrat SoS, there is no way the DNC could put another new candidate on the ballot. In general, I would assume the bonafides of Kamala would have been checked in 2020 relative to being VeeP or President, hard to say though, as all those folks in DC think they are smarter than anyone else, and honestly, the elite political leaders and MSM cannot be trusted.
  16. Is the oldest child married, or moving toward marriage? As @pushbrk stated, your USC petitioner (spouse? sibling?, parent?) assuming a spouse cannot petition the oldest child as the marriage occurred after they turned 18. The other three children require separate petitions (I130s) and supporting evidence to actually get a visa. When you get your visa (I am assuming a marriage based visa) and enter the US as an LPR (green card holder), you can petition for the oldest child if they are not married. If they are married, or marry even after your petition, they will not be eligible for an F2B visa, and you would need to submit a new petition after you naturalize as an F3 visa which will take 15-20 years. The good news is as a Canadian citizen (I am assuming this), the oldest child can visit.
  17. I will defer to @mindthegap regarding complicated I751s. Personally, I would not travel right now at least until the NTA is cleared up, and you might want a lawyer to help you with that. I expect the court, when it gets to that would drive a new filing of the I751 which of course you already did. Good Luck!
  18. Yellowstone is great, and Grand Tetons is just South of Yellowstone. The hike along the canyon rim was amazing, and the hikes around the hot pools was great. It can get really busy at Old Faithful, but otherwise in late September it wasn't too bad. One note, October 1, much of the park amenities shut down in both Yellowstone and Grand Tetons in preparation for Winter. If looking to California, you might want to consider Death Valley. The hikes there were amazing, and since we do not like it really hot (my wife actually does, but I convinced her to avoid July/August based on my work trips there) we visited in mid-October and it was not too busy. It really depends on what you like, we enjoy geologic formations, so DV, and the parts in Utah and Arizona are definitely on our favorites list. Not yet. Big Bend, Carlsbad Caverns and Guadalupe Mountains are on the list. Planning on Glacier, and possibly Teddy Roosevelt next year, but also considering Acadia. There are so many guides and YT videos out there. We like to find the less traveled trails in the popular parks and scope those out. Our favorite hike is still Telescope Peak in DV, the view from the top (a little over 11k ft) is just amazing.
  19. It will take some time as @Crazy Cat stated. If the children are minors when you marry (i.e. under 18 at the time of the marriage) then you will need to submit a separate I130 for each step-child as well as the wife. Good Luck!

  21. This essentially means someone actually picked up your case and reviewed it. It is hard to say if it means anything more than that as it could just be someone checking the application for obvious missing evidence, or something like that.   22. I130s go through 3 stages, USCIS, NVC, then consulate. To request an expedite you have to send it to the location that currently has the petition, in your case USCIS. At @powerpuff stated, the consulate has no authority over USCIS, but you can send an expedite request to USCIS.
