    Pakistan airspace is not closed, only flights are cancelled.. in saying this, they’ve said no Pakistan nationals have been abandoned they’ve either been brought back or accommodated..
     
    flights will recommence from 5th April..so no need for any kind of over stay if her return flight is already booked for late April

    When Pakistan closed their airspace a week or so ago - there was literally no warning at all. There was no announcement that "we're closing our airspace in 3 days, so get home now." There was only, "our airspace is now closed."
     
    I think there's a pretty good chance it will open again sometime between April 28th and June 18th. So I don't think we're going to have to worry about it. But my question was theoretical. IF it remained closed from when they suddenly announced it recently - until say, July 18th and she went home on July 19th... would they consider that a valid reason for over staying? A natural disaster that caused unforeseen consequences beyond her control. And yes, I'm sorry - but this was quite unforeseen. We had no idea that the country she was flying back to would completely close down their airspace to ALL incoming foreign flights.  And if they were to keep it closed from March until July - that would be quite unprecedented and therefore also unforeseen and unknowable. 
     
    I'm just asking - don't they have certain types of events that they give people leeway for?
     
    And SusieQQQ - I would appreciate it if you would refrain from responding to my conversation here. I've found your replies to miss the point and be completely unhelpful. So please... just stay out of this conversation.  Thank you.

    BTW, I am watching 100 cases around ours. Until yesterday about 5 were decided/issued permanent GC. As of Oct. 26th - 13 cases changed status to "case was transferred/new office has jurisdiction". If I were to guess, those are the cases that are selected for the in-person processing/interviews. We'll see if the rest will start being adjudicated in the near future.

    ACA credits are not mentioned in the rule change proposal. However, Medicaid is, and CHIP may be included, DHS is requesting comments. Many states administer CHIP together with ACA and Medicaid in the same state health plan/portal, so if these rules are enacted, recipients would have to determine whether they are receiving Medicaid or CHIP.
     
    Also, DHS will be paying closer attention to medical conditions that are not grounds for inadmissability, but in their opinion may indicate future public charge likelihood.

    Yes! You can file online too! With N-400 not a lot is required like it is for ROC. If your ROC is pending, they might join the two cases (I have little background on this, so read before applying).

    I received the same copy of the extension yesterday. Wonder if the original will ever make it to me lol! at this point i am so over this removal of conditions process  i cannot even get myself bothered about this extension. To make myself feel better i have started my online application for naturalization 40 days early lol!. Will keep updating it over the next few weeks so it doesnt delete it in 30 days then i wont have to start over. I just cannot wait to never have to deal with USCIS again. I am so over it!

    90 days prior to your 3 year anniversary of becomming a permanent resident.

    And I'm wondering how the Trump administration's pending new rules are going to affect us.  Apparently, they are changing the rules in the middle of the road and coming up with every excuse in the book to not allow removal of conditions on current greencard holders.

    You need to apply for a tourist visa completely on your own merits and prove you have very strong ties to Morocco. There is nothing your girlfriend can do to improve your chances of getting a B2 visa; in fact, her "sponsoring" you can work against you.

    Oh right!  Thank you so much!  We're just about ready to file for AOS and it was so long ago (two and a half years and more) that I last looked at all this stuff I've totally forgotten how this part of the process works!  I guess I should start a new thread though rather than hijack this one.  
     
    That's an amazing story about immigration showing up at your door!  I had also forgotten about those stories.  I'm glad I came across your story here, that you told so well!  I'll remind my wife if we get any unusual knocks, not to be afraid!

    You'll be doing ROC (remove of conditions, form i751) first and then when your wife has had her green card for 3 years AND has been married to you for 3 years, she can apply for citizenship. If her roc is still ongoing and her citizenship application is sent, it will trigger them to adjudicate her roc

    At 8am this morning, while sound asleep, incessant loud banging on the door as if the house was on fire woke me up.
    Sleepily I stumbled to the door in my night gown and in front of me were a man and a lady announcing they were from immigration.
    Knowing all about home visits I responded as calm as a cucumber : "Sure come on in have a seat, I need to put some clothes on."
    Nothing rattles me anymore on this journey.
    I said to my husband honey get up, immigration is here.
    He quickly threw some clothes on and came into the living room where the man started asking questions.
    Meanwhile our 4 dogs were barking like they were out of their minds drowning out the questions we no longer could hear
    and I said excuse me and like the true alpha told them to shuuuut uuuup. Silence at last. Proceed.
    It was truly like a scene out of Chevy Chase National Lampoon movie,
    Endless Bummer, Animal House, Barely Legal, Threshhold of Hell, pick any title.
    (They should make one about immigration it would be a hoot).

    Questions asked were about travel together, our work schedules, how long I owned my business, etc.
    He took pictures of several things in the house, my African culture decor, photos in frames of us together,
    of my husband's mom, of him as a baby, a photo I had sitting in my
    bedroom of my naturalization ceremony from almost 20 years ago tucked into a forgotten corner of the dresser,
    (I immigrated here over 40 years ago). He recognized that it was from a naturalization ceremony with eagle eyes, must have
    been doing this job for a while. I was impressed.
    Yes, we were all in the bedroom by now, they wanted a
    tour of the house...meaning checking closets, seeing if we really lived together, slept in the same unmade bed and so on.

    Now I always pictured the perfect home visit with a clean sparkling house, having coffee with the investigators
    and exchanging niceties. No, it was just like they prefer it, a total surprise. The house was a mess and so was I with
    a big shiner on my forehead because I ran into a sharp fence post bracket the day before.
    I did point to the beautiful bouquet of flowers he bought me a few days ago though.
    In the kitchen they took pics I had on the fridge with magnets of my family and they took pics of joint bills, joint bank account
     and CC's we had laying around on the table. I asked if they would like to see our AOS "evidence box". They said no.
    They seemed to be only interested in what their eyes randomly caught and peeked their interest.

    Fun aside, they were very nice and the whole experience lasted 20 minutes.
    I was glad they came so now we can move forward from being stuck in the abyss.
    We filed AOS in May 2015, had each a one hour stokes interview Sept. 2016 and now  8 months later after
     numerous service requests, EAD/AP renewal twice, senator contacts, Ombudsman contact it came to this visit.

    He said you will have no problems, everything checked out fine and you are obviously legit as a couple as we see you here like this.
    He said they came all the way from Texas because my filed office is so backlogged.
    He said he didn't know why all the scrutiny when I asked what's up with the checks.
     Again I want to mention the whole thing was like a friendly chit chat,
    relaxed, respectful. Don't let that fool you though, they get exactly what they want to know by friendly chit chat.
    The worst was the loud banging on the door which freaked me out but I wouldn't have
     heard just a normal  knock because we were sleeping and they would have probably left, leaving us marinade
    even longer in the AOS background check sauce of despair.

    So why the constant hurdles for us you may wonder. I don't know.
    It took us 5 years to come together, first K1 refused after 16 months in AP, second one approved.
    I had petitioned someone else in 2005 which was also refused after long AP and he did not make it here because
    I stopped it due to his fraudulent motive I discovered in my own investigations. The louse was a liar.
    Interestingly, lots of questions were asked during the AOS interview about that.
    Other flags may be that we had several trips to Turkey, a somewhat flagish country to visit these days and Cyprus being close to
    Syria, him having a Muslim name (he has been an active Christian all his life) and being originally from a high fraud
    West African country.

    I will update when he receives the green card. We have been a couple since 2009.
    Almost 3 years married.
    Long story short, no sweat if you have a real relationship and abide by the requirements then eventually
    you will be approved. If at first you don't succeed, try again, is my motto.
    Never give up, keep your cool and be patient. Be yourself, try not to open the door in a night gown though
    and throw the robe on before you open the door.
    If we can't mention the funny parts of this and laugh at ourselves then we are taking ourselves way too serious.
    So relax and chill and I wish you all  speedy approvals for visas and AOS, ROC and naturalization.
    There is always a silver lining for a long drawn out AOS, we qualify for a 10 year green card now because we are married
    over 2 years and don't have to ROC. Yay !

    We are constantly reading on this and other sites about the time K1s take to be completed, meanwhile, visa cheats circumvent the process by applying for B2s (often under false pretenses), tell the CBP folks they are just here to visit some 'friends', then marry their undisclosed American BF/GF, and file for AOs, chilling out in the US while others are forced to wait outside the United States...in just about every case posted here, the first hollow statement made by the alien seeking a good story or excuse for the pending AOS is,' gosh, we had no intentions of marrying and having me stay...'...sure....anyone can easily abandon their lives in minutes and take up residence in another country ....could you? Could I? No. How many Americans visit some third world cesspool of a country, find the 'love of their life' in ten minutes, abandon their lives in the US and take up a new life elsewhere? Maybe one a year>.
    Even considering moving to Western Europe for 99% of us would not be a decision made at baggage claim....thus, the people claiming otherwise are not be forthright...they knew they had no job to return to, they told their families good-bye, etc, and then engaged in a charade....it's time to put a halt to this abuse of tourist visas...end all COS or AOS from B2 visas, without costing the U.S. taxpayer a dime....

    For all of you who are waiting for your K1 visas to be approved/scheduled, you might consider contacting your representatives in Washington to END all COS or AOS from B2 visas, because the people doing this, none of whom, of course, ever had the intention of staying in the US, are causing a lot of the delays and other problems you may be experiencing getting your case approved and closed faster.
    The people who change their mind are really nothing more than thinly disguised visa violaters, who have either lied to our consular folks and/or to our border officials. It is time to put a halt to this nonsense. No more changing minds and changing status from tourist visas. The collective actions of these misanthropes cause problems for others even getting tourist visas, and their requests for AOS from their ill-gotten B2s cause log jams in all visa processing at our service centers. End the log jam...end the opportunity for violating the trust of the US government...call or write your legislator today and ask him or her to get behind ending all changes of status (or minds) from B2 visas....make note...it would not cost YOU and I a single cent to have this law enacted.

    Well engagement is just a term that means you are intending to get married to each other. Many people who are not at all religious practice engagements.
    It is a fiance visa, and in order to be someone's fiance you would technically have to be engaged to them.
    That being said, having a ring or anything is not a requirement.
    You will have to both provide statements of intent to marry, which you will have to sign.
    It's sort of a gray area since there really is no clear legal status to an engagement like there is a marriage.
    But I will say, if during the interview you are asked whether or not you are engaged, I would imagine that saying no would be a huge and confusing red flag.

    I will suggest you to get a very good lawyer first to take off the ticket off your record, second your chances to obtain further stay in United States are very narrow.
    USCIS do not want to hear how much innocent you are, or you been scammed or abused they only follow the book. Since your sponcer and ticket to your green card pulled back , You can not get a green card.
    You better start looking into other countries because upon your return to US you might get deported right back cause you have domestic voilance charges and THEY ARE TAKEN VERY SERIOUS.
    Move on, forget about it and start a new life in your home country. Lets say you are in US it will very challanging for you to even get a job because you have a criminal backgound.
    You have 2 options here, 1- Move on and stay where you are, or find another country.
    2- be ready and drain your money on lawyers and live a very bad life fight for rest of your remaining life.

    What you did not mention was a dowery
    As in Morocco my husband was obligated to pay a dowery to me
    and he still owes me a small donkey as i saw a cute one and said that is what i want
    but on serious side
    if you promised a dowery, you need to tell this community so they understand
    and i am sorry for you loosing your chances

    What are you going to sue them for? Hurt feelings? Illegal contract to buy a green card?
    You will be laughed out of court. Good luck paying for a US lawyer at $200/hour to fight your case.
    Divorce and move on with your life.

    There is nothing you can do, you are not even in the US. Why are you so concerned about your green card? Sounds like you only married in order to obtain it in the first place, you don't even have one so you don't have one to lose. You have ZERO rights to anything in this country, immigration here is a privilege NOT a right. If you left a good job to come here, find another one, you're a big boy stop whining.. You are not going to find much sympathy when it's clear the entire family is nothing but a bunch of scammers and you will get no where with VAWA considering you are out of the country with no way to get back and the domestic violence charge was against you. Get divorced.
