    Wow. The act was NOT a "pay off to feminist and man-haters", while it is called the Violence Against Women Act, men can and DO use it as well to adjust their status!
    This fact sheet from the USCIS specially uses language such as "he or she" and "spouse" rather than "woman/she" and "wife", so it is designed for BATTERED SPOUSES, it's not just for women.

    There's nothing wrong with Tany. You can have all the chances in love and life that Allah will bless you with. Tany's point is that the US Consulate in Casablanca will likely not see your situation as another chance at love. They will see your situation as another chance at getting a visa to America. That's all. What's wrong with you for not being able to see that?
    If you don't like her answers, you're really not going to enjoy the consulate's answers!

    As said by previous folks, Nigeria is in the top 5 of most fraudulent countries when it comes to marriage and visa scams so it will be VERY difficult to get approved of a tourist/any spousal visa. If he does get a visitor's visa you guys can get married in the states but he has to go home and go through the proper appropriate immigration channels. I don't think it matters where you start the K1 petition but he has to be outside of the US while the petition is ongoing.
    That said I implore you to be careful with how fast you want to get married to this guy. There is a reason why Nigeria is high on the fraud watch list. Some Nigerian spouses claim to be so in love but as soon as they step foot on American soil they start to 'change' and the next thing you know you're back on VJ asking how you can get your husband deported because they used you for a green card. This could be true love but same as how age is nothing but a number to US and their MENA spouses, love conquers all including time so take the time to date.

    So I gave in and finally called the military help line to check on my status My paperwork was received at Frankfurt Consulate on 28 February and I should be hearing from them within 30 days. The VERY nice person on the phone told me that our military mail addresses here are sometimes slow to receive mail (very true, unfortunately) and to maybe check back with the military help line to double-check the status and make sure I'm not missing an interview invitation because of it. I will also email the consulate again and make sure they still have my email address on file as well as our physical address in Germany so they can send an invitation there. I guess things ARE actually moving along... Wooot woot!

    Geez, no! This isn't true. She can marry anyone she wants, anytime she wants to. Entering with a K1 visa doesn't make it illegal to marry someone else. It just means she won't be able to adjust status and get a green card. She won't be deported unless she overstays and ICE gets their hands on her (which is unlikely), and she won't get a ban of any kind unless she overstays by 180 days or more. She can marry her new boyfriend and leave the US before her I-94 expires, and she won't have broken any laws. Getting a spousal visa based on the marriage - that's another story...
    Yes, this would be perfectly legal. The biggest problem she'll face is trying to prove the relationship is legitimate at the CR1 visa interview. If someone enters the US with a K1 visa, the petitioner subsequently dies, and the beneficiary marries someone else, all before the I-94 has expired, that would literally scream sham relationship to most consular officers. Most people would be emotionally wrecked after their fiance died, and wouldn't be ready for another relationship, much less marriage, for a long time. I'm sure this situation is going to smell like a boatload of rotten fish to the CO.

    It is neither judging nor a personal opinion. It is a statement from the information presented by the OP:

    The police found enough evidence to place him on a 10 day restraining order the first time, and when the roommates called the second time, to arrest him for attempted murder. While police do make mistakes, it is nonetheless a reasonable statement based upon the evidence presented that the man is abusive.

    While they were exceedingly stupid from the start, I never ever thought they couldn't get any stupider. I expect they still have a bit more left in the tank too.

    1. A national poverty line is an awkward statistic because the cost of living in New York City is many times higher than that of Oshkosh, Wisconsin. While requiring 200% of the poverty line for NYC residents seems reasonable, it is unfair to those in Oshkosh who may be fine at 125%.
    2. I think some people have different ideas of what the poverty line indicates. The poverty line is not determined to be that income at which one is "comfortable" (although one could be depending on his or her situation). Instead, it is the minimum amount at which one can afford the basic necessities of life. Basic doesn't mean live in an ok part of the city with cable tv.

    There are far too many variables at play here, and I think anyone who takes a black-and-white view fails to see the whole picture. I, for one, am grateful that the USCIS understands the great variation among its petitioners and tries to accommodate these differences.
    I have lived abroad for five years, and would now like to return home to the USA to enter into a PhD program. As a PhD student, I will barely meet the poverty guidelines. I met my husband abroad, and while there are arguments floating around here stating "You could have found your love in the USA," this was not the path my life took. Should I have stopped myself from falling in love with him, because I somehow should have known that I would struggle to meet the poverty guidelines if and when we wanted to move the USA?
    My husband's earning potential is high (fingers crossed he will find a job quickly), but is it possible for the two of us to survive on 125% of the poverty line? Absolutely. I have lived on less. However, if the USCIS did not allow me the option to have a co-sponsor, I would probably not be approved and my husband and I would look elsewhere to move.
    I think it's fair to say that no two cases are the same. Are there people getting married who can't even support themselves? Sure, but I don't think povery requirements will stop that.
    Anyway, I'm just grateful that the USCIS sees each case as individual, and does not apply a one-size-fits-all policy. I would likely fall through the cracks that way.

    I would wait for 1 month because I have seen cases where they have denied citizenship because of this issue....it is better to wait one month than to spend $600 processing fee again

    Public transport, Sheffield Wednesday games, (and although I'm a non-drinker) British pubs!
    Food is both yes and no. On the one hand it's surprisingly easy to buy British groceries in northern Colorado (processed items such as Weetabix, marmite, chocolate bars, marmalade, custard, salad cream, Branston Pickle, Robinson's squash, Irn-Bru etc are even sold in our local supermarket) - but it's almost impossible to replicate true British meals. The ingredients, water etc just aren't the same over here.
    I would KILL for some proper Yorkshire fish and chips. Never mind a bacon butty. America doesn't have the bread, or the bacon to do that.
    Miss British humour too.
    I also miss London. Terribly. Its wealth of culture, its history, its cosmopolitan/ multi-racial population, its size, the anonymity of it.
    But I love my wife and my daughter more, so here I am.
    EDIT - And how could I forget...... Social healthcare, and a welfare state that's fit for purpose.
    FURTHER EDIT - And how could I forget this - decent annual leave (I had 32 days in London - it's 12 days here).

    Food is a big thing for me too- strong, milky tea (fortunately found a local shop that sells Irish tea bags!), tea biscuits (plain cookies, nothing like it here!), and good dark chocolate that doesn't cost a ton. I also miss reliable, cheap public transport.

    I am sorry to hear this. My suggestion would be to communicate explicitly with him about his behavior and lay out your expectations. Ask him to act in a mature manner and tell him to address these issues that you are experiencing. If he responds in an immature fashion, you will know what to do.
    What is important to sustain a relationship is not love or chemsitry or anything else like that. What is important is the character of the other person. If they are of a good character and they respect you then they will work towards the betterment of your relationship. If a person only thinks about themselves and their rights and what they want then you will know that no matter how much you try and compromise on things you will never be able to satisfy them. You know your husband better than all of us. You will know what needs to be done.
