    Can the assets be easily liquidated? Listing things like your primary home, care, car etc. would not be acceptable. How many times the minimum value were these assets worth?

    Did he get the cars officially appraised? He can't just say "I have a car worth 5000$". He has to get them appraised by an appraiser and have documents to back that up.


    Also, when you answer RFE's you want it to be WELL over any proof needed. If the assets weren't officially appraised, then they are counted as 0$.


    When you came in on a K-1, did they only look at him making enough to cover 100% of the poverty guidelines? Did he use assets on the I-134? Did ya'll have a cosponsor for the I-134? MOST places look at the 125% poverty line even when doing K-1 so things like this are more avoided.

    Did you make sure to send tax returns, w-2s, all supporting schedules and/or a tax transcript?

    Click on the form. He has to prove he currently makes AT LEAST the number listed for the household. If he has any children, and has listed them, he has to include them in the household even if he's not financially responsible for them. He CAN use assets to cover things, but...


    If he uses ANY assets to make up for the income not meeting, he has to make THREE times the amount of assets to cover.

    So if ya'll are just a household of 2, your spouse has to make 20,025.

    If your spouse only makes say 15,000$ a year, then his income gap is 5,025$, so he would have to prove he has AT LEAST 15,075$ in assets, either in the bank, or things that can be liquefied and officially appraised.

    Again, as others said, letting us know EVERYTHING that was original sent, and anything you sent as a response to the RFE will help us understand why you were denied.


    As for you being able to stay in the country. No, immigration is a privileged, not a right. Just because you marry a USC does not mean you could ever be allowed in the US. It's up to the government, and they rarely care about the heartache anyone goes through for those who get separated. A lot of people have found this out the hard way, thinking they could get married and everything's settled, only to try to come here and realize it's not as easy as just moving in and living life.

    Depends on how you both want to go about this.
    There is no real "fast" way.
    There is the K-1 visa, where you would come here to the US and get married within a 90 day period. This is the "quickest" option of the two if there is no issues along the way. But then you have to deal with adjustment of status afterwards also.
    Or CR-1 visa, where you two can marry and the USC can petition for you as their spouse. This one takes a bit longer than the K-1 but has it's own benefits too like immediate green card, costs less...

    You received an RFE for an improper I-864. You responded with another improper I-864. They can deny if your RFE is not correct. They gave you at least 2 chances. If you had met the requirement they would not have denied you. So, sorry to say, but the requirement was not met.
    If your husband did it then he should come here and ask, since just saying "it was enough" is not going to help you.
    You can reapply, but you will need to figure out exactly where you went wrong and rectify the situation. It sucks, but it is fixable. Good luck.

    How is a visa denial against her human rights or his constitutional rights?! It is neither a human right to be allowed to immigrate wherever you want nor is it a constitutional right of a US citizen to bring a foreign partner who is not even a spouse to the US without fulfilling the immigration requirements.On a side note: except for Australia and Canada I don't know of ANY OTHER country who allows a partner who is NOT the spouse yet to be able to immigrate.
    Or take a country like the U.K. Even if you are married and you want your spouse to immigrate with you NO sponsor is allowed and you have to make 20k pounds (25k US dollar).

    How would it be possible? Even the false USC claim aside, OP has a 9C ban which can only be waived after 10 years outside the US, but OP seems unwilling to spend 10 years outside the US. End of story.
