    It is NOT illegal to come to the US to marry and leave again to begin the processing. It is illegal to come to the US with the intent of marrying and staying without a proper visa.
    OP: Make sure she has plenty of proof for her ties to Japan and she does not lie to the border agent.

    Legally yes, but practically you know very well that there are thousands of couples who just met on the internet, met in real life once during vacation and then decide to get married without even having lived together for longer than a week.
    When you live together and see each other everyday, sudden it is all not sugar sweet as expected and you start to see the other sides of each other.

    You can apply for a B2 visa and it will not hurt your spouse visa process. Expect your application to be denied due to immigrant intent.
    I suspect your spouse actually filed an I-130 petition for alien relative. When that petition is approved, you will apply for a CR1 or IR1 visa, which are the currently available spouse visa categories for spouse of US Citizen. K3, is effectively obsolete and has be virtually unavailable since for three years. It stopped saving time six years ago.

    We met online in November 07 but did not meet in person until April 08 although I booked the flight in December. By the time we met it was as if we had known each other for years. People say things like, How can you marry someone you hardly know? etc. I think we actually got to know each other better by speaking every day online than we might have had we met in person sooner.

    Actually 'left coast lady' you do not have to be a resident of a state to get married in it. And yes, I do know what I am talking about because I had my notary license in Michigan and that is not a requirement. Just because I didn't get married there does not mean I don't know what I am talking about...Thanks

    The online status looks fancy, but it is useless. It sits there doing nothing until it gets approved. They send you the approval notice in the mail. I know its opacity is unnerving, but everything is fine.

    The above is mostly correct. I would add that even if a CR1 visa is issued, if the US entry occurs after two years of marriage, the "status" is IR1, resulting in the 10 year card. For example, you could be married 20 months at visa issue, then wait until after the second wedding anniversary to enter the USA. This would entitle the immigrant to IR1 (unconditional) status.

    On topic... What the OP wants to do is NOT illegal. He wants a visitor visa for his wife so they can visit the USA. That's it. I'm assuming once he has permanent residency in Malaysia then it would not be so hard for her to get the visitor visa. But as of right now he has a visitor visa and it's hard for his wife to obtain a visa because of that.

    shortly after whining about my cell phone bill i was reminded by my wife that I was receiving quite a hefty discount from the cell phone company I worked for in Canada. Soooo missing my cell phone bill can officially be stricken from the record and I definitely do not miss my job. Sour Patch Kids are no match for Fuzzy Peaches and Cherry Blasters.

    See they don't care about YOU. You need to remove yourself from this whole shinanginas and only only include your PR request, because her being married to you, if anything, only makes things worse. Makes the possibility of her hypothetically staying and removing conditions higher. Next time you need to jam pack your case with ties, HER ties to Malaysia. I can assure you, what happened is not discrimination , it's usual tourist visa business. If you ever think you need reasons from third person unbiased point of view, re read what people have said in this post.

    Well there you go. I'm not trying to be a jerk, I'm just not the one needing the info. Some just sity and wait and wait.... squeaky wheel gets the grease. You as a American citizen should know ur govt better than me, and know who to contact.

    For example, in Canadian passport photos or driver's license photos you cannot smile. Period. The photo is unacceptable to them. They will reject it. For all of my husband's military and government ID he could not and cannot smile. He wasn't supposed to smile for his passport photos either. Face recognition software is what makes the smile not a generally accepted expression in the photograph. It's also why the photos should be a certain size, why the head has to take up X amount of the photo, why the background has to be white and why there cannot be glare or shine on the face. Generally speaking you're not supposed to wear glasses either because the flash used will reflect off the glasses majority of the time. Blame the software that makes a person with a smile into someone different than that exact same person without a smile.
    So if you send it in, and they accept it, congrats for you. That's awesome. But this thread is not nonsense, it is discussing something that someone deemed important. Maybe next time, someone should call the NVC and ask them directly.
    BTW a smile is not a neutral expression. A smile shows happiness, it is not neutral. Neutral is no expression. It's not mad, sad, unhappy, happy, glad, excited... it's neutral. It is what your face looks like without expression. You're not supposed to frown either.

    Legal resident as in, you're there legally, not illegally.
    Because you have been married for longer than 2 years, your husband would be applying for a IR1 visa and receive a 10 year green card. That is versus someone like me who has been married less than 2 years and will hopefully get a CR1 visa and 2 year conditional green card.
    Like Penguin mentioned, make sure you file for your son's birth abroad and get his US passport.

    If the marriage does not work or problems can not be solved maybe you should go divorce and go back to your country. If I was in a divorce situation, I would not even want to stay here in the US alone so I would go back to my home country asap with my family. The inmigration status would not even be my main priority! I guess each case is different.

    I think any time you marry someone you don't really know, there's a high potential for problems.
    The system as it is now isn't conducive to getting to know a person, or to really spending time with them. You meet someone (often online, these days) and think you're in love. Of course, you can only know part of a person online, the part they want you to see. Then you get caught up in the romance of it all. It's a perfect love story - you're destined to be together, but the bad guys (the government) are in the way. You have to overcome it all to be together! The problem is that you're so caught up in the romance of it, you don't stop to actually look truthfully at your "relationship" for all its flaws. When the fight is over, so's the romance, so's the fantasy, and reality can be very disappointing.
    Well, that's the way I see it, anyway...

    Mojority of forgein marriages are fraud? I get sick when i hear comments like that ... Sorry, but you have been misinformed! The majority are real, but there are also a few fraud ones, mostly from the same countries.

    Never explain to the manipulator. We give them choices, and stop talking: do the work or I leave you. Any explaining gives them exactly what they want: to argue with you and wear you down, to work their manipulative magic on you. Oh poor baby, look how bad he feels that you would think he is taking advantage of you.
    If he believes you are serious, and he really wants that green card, he'll be here quick and then you will be married to the guy who has made you miserable for soooooo long, and he'll have his green card. You'll get to argue about sending the money home, and he is going to crush your self-esteem even more than it is now. Others who know you are telling you what he has made you into. A decent spouse makes us feel like we are on top of the world and can throw thunderbolts across the universe.
    That's why the appearance of having strength here is not something to get too excited about. Because what the manipulative genius does is give you just enough to convince you to stay with him longer when the right decision is to give him the boot.

    What I make of it: OP was going through a rough time with dating when tada, here comes Prince Charming completely out of her league. She becomes infatuated with him, he becomes infatuated with the idea of marrying an American doctor. The OP doesn't want to admit to the truth, so she wishes to receive from her husband things no one would ask from an arm-candy. She is disappointed and wondering why she isn't getting them.
    Well, OP, that wasn't the deal you signed up for. I don't believe in big differences between partners, in looks, brains or money.
    Learn to love yourself, even if you are single forever. Hell, go to India and get impregnated by your hubby then dump his sorry ####. Or enjoy the months/years you will have together until he leaves you.

    The I-130 is just a form. What you want is letters, emails, phone bills showing you called eachother, photos together (especially with eachother's family) etc. You can send a little of that with the I-130, but the bulk of it will be brought to interview.
