    It means your I-485 wasn't held by the officer. Back then, you probably filed form I-360 and asked to put the I-485 on hold. The officer isn't obligated to put on hold the I-485. Refile a new I-485, and as soon you get the I-485 receipt send a letter to USCIS (the one that denied your I485) AND ASK NOT TO FOWARD YOUR CASE to the Court, because you refile a new I-485, and then submit copies of your new 485 and  I-360 receipts.

    The basis for the denial was because on October 19, 2020 you did not have any other approved visa to adjust from the denied it.

    There is nothing to reconsider. He had not filed for VAWA at his appointment. He admitted no longer with spouse. His VAWA was approved in 2022. Two years after it was denied.  
     
    The only way he can ask for reconsideration was if he filed for VAWA prior to October 2020 date and his receipt reflects that date. 
     
    Furthermore. USCIS does not have to hold your I-485. There is no requirement to do so. The IO adjudicated it appropriately. 
     
    You are going to spend money and resources for your reconsideration to be denied in another year.

    She has no way of coming back in 3 months, she will have a 10 year ban anyway and no Visa.

    As you can see USCIS looses over 200 million in fees every year and for a self funded agency that is a lot. How are you able to maintain with the only amount of staff your budget allows. If they had that money they can open up more centers and distribute the applications.

    They are looking at your Gross Adjusted Income on your income tax form. Line 22 I believe. If that is below what you need for 3 people than you need a joint sponsor.
