The key word is FILED. Not approved or completed. So has anyone ever FILED for you besides your current petitioner (in this case,  you = beneficiary). If so YES, if not NO. Most answer it NO as they have never had a case FILED for them prior to their current petitioner.

The way you present your case is confusing. You are better off asking your friend to join Visa Journey.

    Welcome to the forum.

As missleman mentioned, It may be wise to consider having the ceremony after getting married in the US. Another option is to forego the K1 visa, and go for a spousal visa instead. You can have all of the traditional ceremonies and festivities that you want, and not worry about having to try to evade or lie to a US Consulate officer during a K1 visa interview. Doing those types of things could only get you a K1 denial and a possible ban.

Good luck on your immigration journey, and Happy Holidays.

It is something which should be planned long before the new immigrant arrives........borrowing the money is much better than being out of status.

There is no hard and fast USCIS regulation about the timing of filing AOS. The best suggestion here at VJ is to file your AOS/EAD/AP as soon as possible after you get married, hopefully well before your I-94 expires. The reason for that is that when your I-94 expires, you are out of status. If you live near the southern border, there have been reports of CBP officers at mobile checkpoints and at domestic air terminals, checking for valid immigration papers. When your I-94 expires, you will not have any valid immigration papers. After you file your AOS/EAD/AP, you will receive your NOA1 receipt of AOS application. You would then be in a "special status" since the NOA1 document shows that you have filed for a Green Card (GC) and are awaiting processing. If you encounter a CBP checkpoint without a valid I-94 or AOS NOA1 receipt, there is a distinct possibility that you will be detained. You could be detained until you can have a hearing before an immigration law judge. It has been reported there is likely over one (1) million cases pending in the immigration judicial system. SO.....file your AOS/EAD/AP...AS SOON AS POSSIBLE, if not sooner !

When traveling in areas near the southern border, or for domestic air travel, I would suggest that you carry your valid passport, a copy of the marriage certificate, and your valid I-94 or AOS NOA1 receipt, to avoid immigration official entanglements.

On to another matter, we need a little housekeeping from you if you will. Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline OR your Embassy it's hard for us to give you a factual answer. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile. If you look at the profile of others here, they have a flag for their country, so it makes it easy for us to reply as we can quickly determine their Embassy. The country that should be used is the country where the interview will take place.

So, if you could help yourself out and complete your profile that sure would help us out when we want to reply to your question with factual information.

Go to the top right of this page select your name (it's on the upper right-hand corner)>my profile>[below your picture on the right column] edit my profile. Scroll to the bottom and fill in "Immigration Info". There now we can better serve you.

Once you finish that then return and you will see a flag in your profile. Select it and see what wonderful information will open up for you.

Thanks, and good luck on your immigration journey.

That would be the logical answer. If stopped by a CBP officer or ICE agent and asked to produce your immigration documents, things would likely go smoother and quicker if you had all of your proper documents with you. Without those documents, you may be detained until your immigration status can be verified. By proper documents I mean: unexpired I-94 or Form I-797C NOA1 AOS receipt, valid passport, and marriage certificate (if the last name has been recently changed).

Good luck on your immigration journey and Happy Holidays !!🎁

Take everything they instruct you to take........the consulate has approval of all documents. Co-sponsors don't have to be there.  I would keep the interview.

If you are asking whether there is something you can do to hasten the NOA2, then no.  Be happy that the petition approval wait times are what they are now - last year, minimum was 6 months.

Pitaya reacted to geowrian in K1/K2 delayed submission of AOS (3 yrs after arrival in US) are we still eligible?
As noted, you can AOS via K status still since you married within 90 days.
    No I-130 needed.
Past taxes can be amended if needed.

You were lucky not to have encountered ICE like some folks (https://www.visajourney.com/forums/topic/712332-k1-visa-ice-came-to-my-house/). Spending time in detention and/or having to see an immigration judge is not a fun (or sometimes cheap) experience.
Financial aspects are something that should have been planned for prior to obtaining or using the K-1. Things do happen, but the application fee is something that should be set aside beforehand. If a joint sponsor became needed, that should be a top priority for a spouse. I can't imagine ever putting my wife through the uncertainty of her future in the US, not being able to work or drive, etc.

Doing a walk-in for biometrics was the thing to do for the last couple of years, lately it has been kind of hit or miss. Check out some of the many relevant postings in the monthly threads located in the K1 Progress Forum for more current information.

Trying to understand from your timeline, you got married and are now filing your AOS? Did you also concurrently file for EAD and OP? When did you mail your app in?

I am relatively certain that there are likely thousands of people that would love to hear more about your expediting of the AOS application and your expedite rationale.

    REF: https://www.uscis.gov/forms/how-make-expedite-request

Agree with geowrian's assessment of the usual scheme of events. However, since this is the holiday season, I wouldn't hold out a lot of hope for much of anything happening at USCIS.

You must have an appointment letter to do a walk-in still. Not all ASCs accept wak-ins.

An expedite filed with the initial application usually doesn’t make sense as biometrics must be completed before they can proceed with the application...normally you request an expedite after biometrics as a result.

You don't file I-130 if you're K1. You're probably thinking about I-131, which is Advance Parole.
Just one fee for the I-485. 131 and 765 are free when filing along with AOS.

The best thing you can is research. There's a lot of guides here with all the forms and evidences you need.

I highly suggest you study the K-1 applicable immigration guides of this web site.  It will answer your questions.  Her traveling out of the US in April 2020 is doubtful as she will need an approved I-131 to re-enter the US without abandoning her Adjustment of Status.
