Bored houseguests sometimes leave, sometimes they become a huge pain. Hoping they'll get bored and get lost on their own isn't how you solve this problem.

VAWA was intended to deal with cases like this, take advantage of it. As for the "go back to your country" replies, come on people, she came here in good faith, that's enough for the USCIS, it's good enough for me.

IIRC, the first step in an Armenian wedding is blessing the rings. The couple is not married at that point, and presumably the idea was to stop there. Wedding interruptus. Bad idea, very bad idea. Very easily misconstrued as a wedding by someone unfamiliar with the details of the church's protocols.

Thank you S_R, Leatherneck and Rufus2012 and DeeDee&Sam for your kind replies. I will seek assistance and will move to a shelter before my husband gets released from jail.
It's kind of heartbreaking to realize that a lot of people see bad intentions and fraud everywhere and advise the person to go back to their home countries. They don't realize how hard it is on them, I never understood why people give that advice? If the person asking for advice wanted to leave the US they wouldn't be on this forum trying the find a solution, they would be back home because it's the easiest way out, you just buy a ticket and leave. Also, I noticed that Symply_Me, who is blaming me for not coming here on a fiance visa and 'jumping' into a marriage 5 months after entry has entered the US himself/herself on a VWP not a fiance visa and got married 30 days after entry! Seriously?

The worldwide approval rate was 99.2% last year (35,000 total K-1s). Unless all those rejections are coming out of one or two third world consulates, it's hard to believe that approval drops substantially compared to the average.
To the OP - life is full of risks, getting a fiance visa isn't one of the ones you should worry about.

My fiance brought updated letters to her interview, they never asked to see them. The DS-156k has a section where the fiance reaffirms their intent to marry, which is probably what suffices.
It may vary by embassy, and the 5 minutes each it took us to prepare these letters was worth the peace of mind.

Not every petition undergoes the additional steps that are being labelled as "AP" on this thread. There is some additional processing which happens at random. My petition experienced this, and it was in this state for about two and half weeks in December 2011. I went from being told it was ready to ship to the embassy to "extra processing" for those two and half weeks, and only then did I get the consistent answer of "on its way to the embassy" from NVC's phone help.

By "positive" you mean "informative and correct" Right?
You expected to hear back in 3 days? I think most stress in the world is caused by unrealisitc expectations.
They will not send a notice they received anything, this is not the filing of a paid petition or application, you get no "receipt"
The online update system is notoriously unreliable. Would you listen to the weather if it was wrong 65% of time? Our case shows "initial review" and Alla is a citizen now. Stop looking at that. It may never be updated.
Expect to hear something in 2-4 weeks.
The visa is the easy part. I understand this because I have been through the entire process. Have you prepared for the interview? Have you prepared for her moving here? Have you collected her educational information, transcripts, had them translated? Medical records, dental records? Had them translated? What about shipping some of her clothes, books, kitchen utensils? You are moving a LIFE across the world and there is plenty to do besides look at unreliable government update systems.

I haven't read the thread past this post. If others have concurred, great. The thing for the couple to do now is to officially and legally marry, then file the I-130 to start a CR1 visa process. Atop the I-130 package, add a letter withdrawing the original I-129F petition.
There's no sense arguing or appealing. The couple posted a wedding album and took a honeymoon. When you and your family consider the couple married, then you are "too married" for a fiancee visa and "not married enough" for a spouse visa. It's a common "Catch 22". People get into this situation when they are not "honest" and "accurate" in their communication.
Just chalk this one up as another in a long line of similar stories coming out of India. Other readers can learn from this mistake.
The Kuwait couple having an Orthodox Priest bless their "rings" at an "engagement ceremony" are playing with fire and gasoline together. Time for a change of plans. Marry or don't marry. No play marriage.

I disagree. Why shouldn't someone want to better their adopted country by participating in open discourse, a protected right of all people here? I suppose I wouldn't do this in China, for fear of retribution, but the US does not punish people for disagreeing, thank god. If these immigrants obtain citizenship, then they can vote and lobby for changes to the way things are done. I think the real issue is that some people are trying to make a solution without understanding why the current solution is in place, and that comes off poorly.
