    Wow. The simplest answer is to do completely the opposite to what you are doing. Try talking to your wife as an adult, insulting her isn't going to help your relationship. Waiting for the visa and living apart is hard but you are married and you should be a team. Act like a team.

    Surely you do know all about the Immigration Reform and Control Act of 1986, right?
    Or about the 1996 Immigration Reform Act (that pretty much allowed deferred action) which was used all the way up until the time our current President took office.
    Look, I'm not debating you on it being right or wrong, but you should know that Presidents can, have, and will continue to do the same exact things the current one is doing. The 1986 act to some estimates at the time gave amnesty to about 4 million individuals.
    Immigration reform is unpopular, we certainly have known this for a long time now. The cynic in me knows not too much will change. If once all legal means to stop DAPA/DACA are exhausted (which hasn't happened yet but soon enough), let me know when the next President has enough courage to tell those families who have now been made legal that they can be un-made. Let us see the scenes of millions of sobbing people being forced back across the borders and tell me if a President or his/her party could politically survive it. Talking points and speeches sound sweet until they actually realize the problem and back away.
    Our lives are political footballs to politicians, one way or another.
    Does it make me mad that our lives take a back seat over those who came here illegally, or even those who come here in the temporary migrant worker program that Bush also loved to use (they get put in front too)? Yes, I am. You're right to also be angry, and I'm not disagreeing with you on that. But it won't be changing, no matter whom is in office.

    They don't like immigrants at all. There isn't votes in helping engaged people bring in their foreign partners. The situation was as bad in the past under Republicans as Democrats and that isn't going to change. None of them care, don't fool yourself into thinking another guy is going to change things.

    Yes, your father came here Legally on a visa, he was here Illegally as soon as his visa expired. He then committed a felony and that is the big reason for him to be deported right now. Yes he committed it because he was found guilty of the crime. So he has shown to have morality problem and which the US does not want immigrants with morality issues.
    You say you have PTSD and Depression.WELL THAT DOES NOT STOP YOU FROM WORKING AT ALL IN ORDER TO SUPPORT YOUR FAMILY. As I have stated before I suffer from PTSD as well but due to being in Combat in Iraq, I suffered from depression as well for a couple years until I found it in myself to get above that. There are many Combat Veterans like myself who suffer from PTSD and still work in order to provide for our families.
    I know people from my time in the Marine Corps that take care of their parents while they are in the Military, and thus the parent is considered the dependent for all intensive purposes. Just because you might have to deploy and be away from your mother for a period of time doesn't mean you shouldn't join.
    The point I am trying to make is that you need to go out and WORK. Make more than $350 a week which is well below the poverty level. Get some skills and start supporting yourself, stop pouting about the whoa is me stuff.

    With all due respect, cases of misrepresentation of material fact require at least a consult and will have a much better success rate with guidance from an attorney.
    I would rather pay for expert advice than wing it and have a lifelong ban, what a gamble.
    I don't think you understand the severity of misrepresentation and it's consequences.
    OP can not interpret the consulate findings and does not know how to sort through and apply the research he has already done.
    One can research until the cows come home, there comes a time when a lawyer is needed.

    How do you reconcile having your home in the U.S. and visiting the U.S.? How does one "visit" one's primary resident? Are you "visiting your wife and children" or are you "returning home" as you stated in your first post?Using the VWP requires a person to have a foreign home, not a primary residence in the U.S.
    Since you feel you are not abusing the VWP, then tell CBP that you are entering to visit your primary residence where you live.
    I'm not trying to be an #######. Just pointing out what may be a flaw in your assessment. I am trying to help you.

    This is veering off topic but:
    1. Government security clearances are not done by the FBI. They're almost always done by government contractors via OPM (office of personnel management, basically the federal government's HR agency). There are a few exceptions, but those exceptions (such as the CIA) do not use the FBI.

    what don't you understand about background checks already being complete by the time the visa is issued? Which it has been. ISIS has nothing to do with a random letter from the FBI being left at someone's door. They aren't going to issue a visa to someone and allow them in the country and THEN do the background checks.

    Not a must if you can prove that religion and/or custom in your country are against meeting in person.
    But I suspect you will have a very hard time to prove the relationship is real and there is actual intent to marry and spend your lives together.

    U.S. Immigration law states that “if it is established that compliance would result in extreme hardship to the petitioner or that compliance would violate strict and long-established customs of the K-1 beneficiary’s foreign culture or social practice, as where marriages are traditionally arranged by the parents of the contracting parties and the prospective bride and groom are prohibited from meeting subsequent to the arrangement and prior to the wedding day.” INA § 214.2(k)(2). Waivers such as these are rarely granted by the USCIS because so few couples have been able to meet the stringent requirement of extreme hardship. For instance, being incarcerated or an inability to travel due to parole or a court order does not necessarily reaches the level of extreme hardship for the petitioner. Nonetheless, each case is evaluated on a case by case basis.

    Due to the fact that extreme hardship is generally interpreted by the USCIS to mean something very close to “physically impossible,” it is generally available only to people who are so disabled that they can’t fly at all. As for the latter waiver, very few people qualify for this exception and those that do often have a difficult time proving it to the government’s satisfaction that meeting would violate a cultural norm or societal custom. In light of the advent of online technology, social media and dating websites, meeting the two year meeting requirement may be more and more difficult to fulfill.

    You posted " He told me that he is now caring for and acting as father to his niece". Are you sure this child is his niece and not his daughter?.
    To make sure he is with you for the right reason, tell him you will live with him in his Country,and wait to see his reaction.I have a feeling he will vanish after that.

    So she is a yoga instructor, classically trained in violin, a model, with a 'friend' in the US., no real great work history, no property in Romania, and no other apparent ties to her home country.
    I certainly hope you can now see how her 'beauty' had little to do with her denial. Moving forward, stop blaming everyone. Enough talk of suing the government or hiring a lawyer, if you really want this girl here, and it sounds like she is much more than your friend, then start focusing on that, or meeting in a third country.

    2) Vote in elections already decided by moneyed interests.
    3) Sponsor even more and ungrateful family/people to the U.S.
    4) Die while pursuing the American dream that is increasingly illusive to the 99%.
    Seriously though, I love this country so much I want to help fix all of the above.
