Hello, my K-1 petition just shows “Denied” on USCIS case status (August 19, 2025). I have not received the denial notice yet, so I don’t know the exact reason. Can anyone share how long it usually takes to get the denial letter, and if I should wait before deciding between appeal or refiling? Thank you.

Sorry about denial.

It takes 2-8 weeks to get a physical letter in the mail.

 

You may consider going CR-1 route instead. I'd wait for letter to know the reason first. Maybe you or your spouse weren't free to marry in the eyes of USCIS

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

There is no appeal.  The case will expire.  That is one of the disadvantages of a K-1.  Normally, the person who was interviewed knows the reason for denial.  Normally, it was due to one of the parties not being eligible to marry or the consulate officer doubts the relationship is real.  

To be clear, are you the US citizen or the beneficiary?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You can travel and get married in his home country, then file for CR-1.  Or meet in a third country close to his for marriage if the home country is more complicated or takes more time/documents.  Another option is to marry virtually via Utah County online marriage, then meet in person somewhere before filing the I-130 petition to start the CR-1 process.  Good luck!

It is not clear to me, was the visa application denied at the consulate or was the I129F petition denied at USCIS?  You mentioned the case was showing denied at the USCIS site which implies it was the I129F that was denied.  The OP needs to clarify at what stage of the process the denial was decided.

Never received one since 2009

 

USCIS doesn't deny a case / they return it for reasons like no signature, missing pages

embassy is the one who denys and that would be posted on CEAC site

 

USCIS would also send RFE for additional documents needed

So sorry to hear about your denial. There are lots of people here with tons of knowledge and similar experience. First off please fill in your time line and give more details.  That way they know how to be of help. Who is the beneficiary and what were some of the questions asked at the interview?

I am the beneficiary. The US citizen petitioner is my fiancé.

  • Thank you. The problem is that my fiancé doesn’t want to travel far because of his age. I’m not sure if he would agree to the CR-1 process

Thank you for your reply. Actually, we never reached the interview stage. My fiancé filed the K-1 petition at the end of October 2024. While waiting for NOA2, USCIS issued an RFE for a divorce decree copy, because he lost the original. We submitted the copy, but about 4 weeks later the case was denied. So the denial happened at USCIS, not at the consulate interview.”
