Timeline

My fiancé is a citizen of India so obviously we can’t get married over there, but I am looking for information from other same sex couples that have beneficiaries from countries that don’t allow same sex marriage. What was the process like for you?

Process will be exactly the same as for straight couples. Find a country you can get married in, or have you already filed the K1?

I have already filed the K1, but we're both worried because he comes from a country that doesn't accept same sex relationships.

I understand, but the marriage will happen in the US, where it is legal and the staff at the Embassy will treat it accordingly

The requirements are the same for all couples and the level of scrutiny a couple might face is related more to how common fraud is in the fiance's country.

 

So it is a good idea if you check the India portal to read on experiences in that specific embassy.

We are worried too so we got a lawyer to help with our process, but keep in mind from what I've heard you will be interviewed from a US immigration officer and because same sex marriage is legal in the US, they can't deny your visa due to your sexual orientation. hope this helps! good luck!

Thank you. I do understand that, I just wanted to know how everyone else’s journey has gone. He is in India, which is a high fraud country, so I was concerned how they’d treat him. He’s very sensitive

My husband is from Indonesia, a majority Muslim country where same sex marriage it's not an option.  We applied for a K1 visa and outside of the normal processing timelines we had no issues whatsoever and the K1 was granted.  He came tot he US and we got married in Houston, unfortunately for reasons outside of our control, he had to return to Indonesia during the AOS process before anything had been approved, so, I had to then reapply for a CR1, spousal visa and that took 2 years until the spousal visa was approved and he eventually came back to the US, this time with a 10 year green card.  You will not have any issues whatsoever with the US Embassy if you follow and comply with all the requirements of the K1 visa.  Good luck.

If one of you is a US Citizen, consider marrying online via Utah online weddings.  From that point on you are already legally married in the eyes of the US, and you can apply for spousal visa CR-1.

Thank you, but I’ll only do that if we don’t get approved. It’ll be my last resort
