Do you have somewhere to go in the US, someone who would sponsor your husband if needed?

 

My inclination is just to fly back, the issue in the back of my head is if the Airline will board him with an expired GC.

People with expired 10 year green cards are to be boarded.

You could fly through Ireland and do pre-clearance if you don’t want to be worrying the whole flight over the Atlantic.

I'm not sure how plausible that would be, but I'll look into it. We won't have a car so will have to rent one and trying to keep costs down.

I'm wondering if anyone can help me, this information is extremely new but my husband is trying to get to me (American citizen) and he has an expired 10 year green card. The ECOs are only allowing him to enter for one month. They say he needs some sort of special document from the country we were living in. 

 

I was told we could get him here and renew his green card from here, but the ECO is telling him that's not true. 

 

Can anyone help me figure out if he can still apply to renew and ask for the stamp in his passport (I-551?) from the US? He's a British citizen. 

 

Apologies if this is the wrong location for this post, I've barely slept and I am really anxious. 

 

*ETA they want him to apply for an SB1 visa. I don't know how to prove he qualifies for that. The reason we couldn't return was we couldn't afford it and then we thought we couldn't.

I guess we're going to have to start over. They took his green card. He has severe social anxiety and had no idea he could request an immigration judge to make the decision. 

 

I don't know whether to try for SB1, or just give up and start over from scratch as my spouse.

Where is he right now?  Who took his Green Card? Did he sign an I-407?  How long was he outside the US?

ECO is an Entry Clearance Officer, sorry if that's not the right term I'm used to dealing with the British side of things. 

 

He's currently on a plane bound for Chicago, delayed though. This is killing me. 

 

He didn't sign anything but they did take his green card.

 

We were in the UK for 6 years, and Germany for 1. We don't own property in the US, I had an adult child living in the US but I don't think that's strong enough ties, and I really can't see him being approved for an SB1 based on how long we were gone. I wouldn't have any way to prove we wanted to come back. 

 

If we have to start from scratch could he do that from here and still get approval to stay and work here while the green card is processed? Sorry I can't remember the name for the spouse visa anymore. 

 

I guess what I'm wondering is how long we're going to have to be apart, I really need my husband to help me raise our kids.

I don't know if he signed anything, he didn't tell me. He just said they told him his options were to permanently surrender his green card or apply for a waiver, and that the woman took his green card. I'll have more info this evening when I have him home.
