affidavit of support what exactly will my wife need to provide? (Merged)

Hello All! So my (now) Wife and I have been in a relationship for 11 years and 3 years married now, We applied for K-1 in 2018 but got rejected (not really, since i only got my passport back with nothing else, so we're still confused). She (lives in the states, obviously) also reached out the Senator's office as well but it clearly didn't work out. The UCSIS kept my passport for more than 6 months and just returned it. Long story short, she came here to Pakistan in 2020 and we got married here. My question now is that She's been living here with me for the past 3 months, she quit her job so how does she provide the affidavit of support? I have my business here and she's helping me out here. Kindly help us thanks!

AOS is at least a year or two down the road as it looks like she hasn't even started I-130. Worry about that at NVC time - she can depart early and get a job in the US, get a joint sponsor...

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Yes, that would be the solution.  She must have a job and income in the USA in order to qualify as your sponsor.  The only ways around that are with well over three times the income requirements in liquid assets (cash essentially) or a qualified joint sponsor.

Facts are cheap...knowing how to use them is precious...

My wife (U.S) and I (Pakistan) are in the process of gathering the documents and evidence needed to apply for the IR1 since we have been married for more than 3 years now. 
 
However, for the affidavit of support what exactly will my wife need to provide? In 2023 and the years before that my wife made over $55,000 but resigned from her job in December of 2023 to come and live with me here in Pakistan. Right now, she does NOT have a job in the U.S and is in the process of looking for a U.S online job and also starting her own online business (she just registered it as an LLC). Will this be an issue? We do not have anyone to-do a joint sponsor with and want to have this figured out before we apply for the IR1. I would also like to add that I have my own business here in Pakistan as well – can I show that I can finically take care of myself in the U.S with proof of funds? Lastly, my wife has been collecting unemployment for 4 weeks now while she continues to look for an online U.S job – will this cause any issues?
 
Any guidance and advise would be greatly appreciated.

Your wife, as a self employed person (currently) will not be able to show any "income" until she files a 2024 tax return in 2025.  If nothing has been filed yet, the I-864 is not likely to be needed until 2025 anyway.  Time to do the homework.  Wife needs to come here and click on the word "Guides" at the top of any page.

Your income is only relevant if it will continue from the same source after you immigrate.  You can also use assets/cash, but the financial bar is higher (5x).

This is what I don't get, if you aren't in the US then surely your income here (England for me) is irrelevant anyway? I am going to try to use assets as I just have no choice and don't have a co-sponsor who will help me with a large family.

I would apply with 2023/2022/2021 taxes. If she made suffcient income for those three years you should receive DQ with a note stating a joint sponsor might be needed at interview. 
The last time I checked DQ to interview is 1.5 to 2 years at Islamabad so you don’t want to draw out the I864 process too long to where domicile also becomes an issue.

Assets is 3X for USC sponsoring spouse (3 years to citizenship not 5…)

Income is relevant if you can show it will continue after you relocate to the US. So, online job based out of the US or job transfer for USC or beneficiary can and has been used at London Consulate. Not sure about Islamabad…

DQ of August 2022 has been scheduled for interview April 2024… 

Get the DS260 and I864 submitted asap. So, you can start your next period of waiting.

Just curious, is that even legal? Even the most generous states don't typically allow for a person to live in another country and collect unemployment benefits...

I know the Canadian unemployment benefits allow it, in some cases - moving abroad to be with a spouse being one. We have a big thread about it :)

Fascinating, I'm sure that policy never gets abused up there in Canada. Regardless, I can't find one US state where it is legal.

If wife just moved to Pakistan and is looking for a job and hasn’t sorted out paperwork to stay in Pakistan isn’t she just on vacation and can still technically collect unemployment as it gets deposited into an American bank account? Will unemployment even know she is overseas? Or do they monitor your travel in and out of the US?
