K1 visa/esta/k2 visa

Timeline

Hi there.

My first time being here.

My US partner and I am keen in the K1 visa.

I am from Singapore and a divorcee with a 14 years old son.

My partner has a previous drug trafficking case 10 years ago. He has yet to get his civil rights.

 

I understand there may be some issues as he has yet to get his civil rights, which meant that he won't have his US passport to apply for K1.

This can be done on his end, how wl the previous drug trafficking affect our case?

 

As for my son, I would definitely love to bring him over ,however it is shared custody with me having care and control.

The whole process to change custody to sole custody may well take a year.

 

How will K2 visa work in my favor?

Should I still go for K1 visa?

 

We are looking to apply in Oct 2024 as I will be in US a month before.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I have read in some forums that some do get denied from entering, I'm under the vwp if that helps!

So why not just apply now to get the ball rolling since you met already in person? You can’t marry if you want to pursue K1. K1 is for unmarried couples

Technically, he could start the process now.  Visiting after starting the process is fine...at the discretion of CBP.  If asked questions, you must be truthful whether he has filed the I-129f or not.

The others covered the K1 part, I want to touch the K2 part. Your son would be the K2. Now for him to move to the US on a K2 you will need either a court order or written permission from his father.

He can get a passport unless there is something other than his felony conviction such as unpaid child support preventing it. I check and it appears he can travel to Singapore with a felony conviction

Personally I have been a felon since 2004 and have gotten a new passport since then and traveled to several countries.

Personally I have been a felon since 2004 and have gotten a new passport since then and traveled to several countries. 

This is great news!! I'll just need him to get his civil rights and get a new passport.

Will this felon charge put us in a situation where we need a immigration attorney?

It is because I am unsure of several things.

The felon issue has been addressed but not for my son😅

How much later are you wanting your son to join?

To start the K1 you just add his name, it is not until it gets to the interview stage do you fill out anything for him. 

If you think your ex will be co-operative you can get him to give you a letter of consent anytime after you start the K1 Process. It is taking more than a year before getting to the interview stage. If you think you will have to fight it out in court then start now.

Your US citizen boyfriend needs to complete and submit the I-129F petition, not you.  The visa application for the K-1 comes much later in the process.  I-129F petitions take about a year to be adjudicated after submission.  I-129F petitioners are also required to disclose their criminal backgrounds with documentation, which could add more time to the process.  Were any of the convictions for Adam Walsh Act offenses?
