Family based immigration ( For parents)

Hi everybody,

                       My son is an American citizen but left when he was six years old. He now resides in Pakistan. He is planning to visit America and will sponsor me and his mother for green card. He will attach all domicile papers and affidavit of support which will be provided by my friend. After application for the parents he will leave in two months while parents will stay in America until the case is decided.

                    My question is it’s ok if he leaves after filing the green card case?

He is in the University at present but will come back in future and make America his home.

As proposed, it is not possible.  The petitioner (Son) must have domicile and reside in the US. He does not and does not have a plan to do so.

He has an uphill battle, being that it’s Pakistan and he’s never lived here as an adult, with no real plans to.

 

That visa is for the purpose of family reunification, which isn’t applicable in your situation.  You may want to wait until he is living permanently in the US.

Visiting is not domiciled. They can verify domicile proof. Because you have a joint sponsor means nothing. Also parents cannot stay. This process will be 2-3 years and that is not including AP.

Son needs to be filing US tax returns as he is USC

He needs US residency and at the 2nd stage of this process ,  he needs to have US income to support the household size

he would need to stay living in the US and show he can purchase health care insurance for the parents 

 

Otherwise do not qualify for reasons stated above by others

Seems like there is a Joint Sponsor

 

Health insurance is not a requirement plus nothing to suggest they cannot afford their own.

 

May well have issues about domicile, maybe other factors as post is confusing

At the second stage, if there is interview he will come back to participate in the interview. There may be challenges over here.

Already stated.  The petitioner doesn't live in the US.  That is a primary requirement.  This is a family reunification visa.

Your son… the petitioner..  will never be interviewed. At the time the visa applicants are interviewed, your son had better  have significant documentation of his domicile in the US and intent to remain in the US as well as financial sponsorship .. or the visa will be deemed NOT  a reunification and denied
