Wait until 2 years married

Hello everyone! 

Hope all of you are doing fine. USCIS recently approved our petition, and they also sent our case to NVC and we received the welcome letter three days later. 

As you can read in the title, we want to wait until we reached the 2 years married to get the IR1 instead of the CR1 (edited, I got confused, sorry) and obviously, save some money. Our 2 years anniversary is on June 2024. We have not started the process with NVC yet. 

How can we delay our process until next year?

 You can delay your case at NVC by just waiting to pay the fees and submitting required documents.  You can delay for a year just by doing that.  To be issued a 10 year Green Card, the new immigrant needs to enter the US on or after the 2 year wedding anniversary.  Good luck.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Correct, and it is the IR1 or ten year green card you are after.  You can get a CR1 visa, say three months before your anniversary, but then enter AFTER the 2nd anniversary to receive IR1 "status".

 

So, you've got about 10 months.  Find out how long the interview queue is for your Consulate, and you could get the visa 4 or 5 months from now and still be ok.  Might not need to delay very long, if at all.

With USCIS wait times, I do not blame you for waiting, to eliminate the removal step.  Just know it will prolong the naturalization process, if your spouse chooses to become a naturalized citizen.  Congratulations!!!

The Naturalization process, would not be "prolonged".  Eligibility will be delayed.

I think that you should make sure you are aware of how your Embassy is timing interviews, there are some U.S. Embassies overseas that have their interview appointments not scheduled for months and months, so depending where your spouse if located the process may take care of the delay without you doing anything out of the ordinary.  Good luck.

I did thr same thing. 

Got married Nov 2021.

Filed May 2022

Approved Feb 2023

Put NVC on hold 4 months. 

Have interview in Aug 2023

Visa will be good for 6 months 

Have until Feb 2024 to enter 

So I will enter between mid nov 2023- mid feb 2024 to recieve I

10 year.

After document qualified. Thr appointment for thr embassy was exactly 2 months out.

Note that the visa will be valid for 6 months (maximum) from the date of the visa medical, not the date of the interview nor visa issuance.  This rule applies to all immigrant visas, regardless of the issuing consulate.

 

My spouse visa was valid for only 1.5 months when it was issued.  My interview was re-scheduled to around 4 months after my medical.
