Question about bonafide evidence (merged)

Timeline

Hi!

I got married a couple of weeks ago in the US and came back to my country of residence. My husband and I don't have kids or any joint accounts, lease contracts or anything yet, and I don't know exactly what to add as evidence, or what would be enough. So I have a few documents in mind:

 

- We applied to a K1 visa last year and decided to withdrawal. A couple of days after our wedding he got the NOA2 in his house - so we're thinking about attaching the NOA2 and his letter withdrawing from the K1 process (that kinda counts as a bona-fide relationship at least, no?)

- pictures of our wedding;

- flight tickets to see each other

- paypal and wise money transactions (?)

- we lived together from 2018/2021 - should I get the contract of that rented apartment?

 

What else should I add?

I would NOT include the K-1 withdrawal letter.  I don't see the withdrawal as evidence of a bona fide relationship.  The best evidence you can provide is your marriage certificate and evidence of time actually spent together.  The apartment rental contract and flight info are good evidence.  I would throw in 1 or 2 personal affidavits.  Good luck.  I hope you have a smooth journey.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Just an FYI, you do not need all that relationship evidence in order to get the clock ticking on the I130.  You can upload all that after submitting the I130, at the NVC stage, and/or at the interview.

Timeline

Passport stamps as evidence you were in the same country all that time, and a few photos will be all you need.  Leave out the money transfers.  They are NOT evidence of relationship in any way, and CAN hurt instead of help.  That's now co-mingling of finances.  That's one person supporting another financially.

Just to confirm, should I not mention the K1 process at all, or just leave the withdrawal letter out? I don't want to hurt the process with a mistake like that :(

I see no reason to mention the K-1.  It could raise questions.   Of course evidence of your time together, whenever, is good.

Just another question still on this topic - My husband, the petitioner needs to mention the K1 in here, right? and then we need to provide additional context? because in our case we got the NOA2 to the K1 but then chose to get married instead, automatically withdrawing. I'm confused whether to add this information or not

Yes.  Name, dates, and result are required.  "Approved" then "withdrawn" would be appropriate in the RESULT box.

Hello!

 

My husband and I are organizing some evidence of bonafide marriage and I'm a bit insecure of not having enough material to provide. We were applying for a k1 visa(noa2 emitted in june) and decided to give up, get married and apply for the cr1. Apparently, mentioning the k1 visa could hurt our application, so I also shouldn't use any of the pictures used in that application? I thought about using some of it to show that our relationship pre-marriage is real.

 

  • We have pictures of our wedding
  • passports stamps of my recent trip to the us, and his trip to brazil last year (the time between the his visit and mine is almost 1 year apart, is that a problem?)
  • chat and video screenshots with time stamps along the year and after our marriage (i came back to brazil)
  • tickets of our traveling together in brazil and in the US
  • his temporary residency card from the time we lived together in brazil

 

I thought about uploading a contract of renting the house that we lived together in 2018, but it doesn't have his name in it, only mine. 

I can add him to my life and health insurance at my current work as my dependent using our marriage certificate, but we're not currently together and he's not living in Brazil at the moment. Is it worth it to seek these documents? My worry is that we don't have enough post wedding material to provide, since we're in different countries.

you are overthinking this 

1.   marriage certificate

2.  photos of marriage and time spent together (those before marriage are fine)

3.  boarding passes

4.   his temporary residency proof

5.   tickets traveling together is a bonus

and other documents USCIS says on the site 

unless u have red flags the other proofs are beyond what is needed at this stage

Mentioning the K1 does not hurt the application. In fact, you have to disclose it, because of this question:

It's not a big deal that you decided to switch from K1 to CR1. Pretty common.

You will need to mention the K1 I-129F in the I-130 petition, in the section that asks about previous petitions filed.  The advice given in your other thread is to not submit a copy of any K1 withdrawal letter previously submitted.  It would not hurt your I-130 case to reuse any of the relationship evidence you submitted with the I-129F.
