I-130 Guidance on Next Steps (Merged threads)

I applied for my mother on I-130 in May 2022, I got an email last week to advise that NVC has received approved immigrant visa petition from USCIS and to pay fees and commence document collection.

 

My mother left the US last week to return to London, (day before status change), she is not due back till early 24. I have a few questions re process and timelines.would greatly appreciate the help.

 

1. After this stage how long does it usually take to process and to receive the Green Card.

2. Is it at this stage we get to select either in US or local consulate processing. which is recommended?

3. Based on her inlines is it best to go with local consulate processing?

Easiest method is to complete the NVC processing, get the consulate appointment and complete the process abroad.  She enters the US with the Visa and Stamp which is good as a green card for a year.

Thank you, that is what I was thinking, even at this stage how long does it typically take?  is it 6-12 months or more?

She is no longer in the U.S.  Her sole option is consulate processing.

No, you don't get to select.  Her only option is consular processing.

She could expect to interview around Christmas.

Much quicker than that, depending on how quickly you pay the fees, complete the DS-260 and submit the docs. Timeline for being DQ’ed after all that is around 2 weeks (https://travel.state.gov/content/travel/en/us-visas/immigrate/nvc-timeframes.html) and then London is one of the quicker consulates for interviews - I was DQ’ed late April and have my interview in mid July. So if you submit by the end of the month she could have an interview around October time.

Not just easiest- it’s literally OP’s ONLY option at this point.   If she returned to the US with the intention of adjusting struts, that would be immigration fraud.

I finally got round to submitting all documents last week (took a while to get together), they have been approved.

 

What are the next steps?  Is it interview  or is it medical. Also how long will it take for the interview notice to arrive?  I am hoping that appointment comes in Jan / Fab as mother will be overseas next few months and is planning on coming to US in March.

The I-130 was approved, or is the case already at the NVC?

I-130 was approved a while back, they requested docs which were uploaded and approved inc police certificate

Okay, so the case is at the NVC now. As soon as that step is completed, they will send it to the Embassy and your mother will receive the interview letter. She needs to schedule her medical before the interview, I would say 10 days before the interview so the Embassy has the results when she has her interview. I was not allowed to schedule the medical until I actually received my interview letter.

What are the estimated timelines for London to receive a notice regarding next steps?

The AOS and Application information were accepted on 19th Sept, I do not not see any updates since, I wanted an update on when the  interview will be (London), what are the current wait times?
