Hello everyone, we just received the welcome letter from NVC. My brother is USA citizen  and will be my joint sponsor. My wife's income is $1000 under the limit. My brother is living with his wife and 2 kids and meets the requirements. My brother paid my NVC fee's. They're working together in same restaurant for 6 years. What documents they have to fill? As I know, My brother and my wife has to file I-864 and my brothers W-2 is will be enough or 1040 and 1099 are necessary too? Thanks in advance.

Your VJ profile indicates you are pursuing IR1/CR1 visa.  Are you the beneficiary petitioned by your US citizen wife?  Is your wife self-employed?  Does your brother file taxes MFJ with his wife?

Yes, my wife is usa citizen and the petitioner. She is self-employed. I need to ask him if he is doing mfj

Thanks for the clarification.  Refer to page 8 of the I-864 form instructions for the financial documents to submit -- https://www.uscis.gov/sites/default/files/document/forms/i-864instr.pdf

 

From petitioner and joint sponsor -- "If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income."

 

From self-employed sponsor -- "...you should have completed one of the following forms with your Federal income tax return: Schedule C (Profit or Loss from Business), Schedule D (Capital Gains), Schedule E (Supplemental Income or Loss), or Schedule F (Profit or Loss from Farming). You must include each and every Form 1040 Schedule, if any, that you filed with your Federal income tax return."

Hello everyone, I need some help. My wife couldn't meet the poverty guidelines so my brother will be my sponsor. My brother is married and has 3 children in his tax returns. His wife is working and she is paying her own taxes but they're living together. Also, my brother supported my cousin in 2019 he is a greencard holder right now. He typed his wife's income in part 6 section 8 (I-864). How should I fill the household chart? Should I count household size 7 or 6? Because he meets the limit by 6 not 7. Im stuck man please help. Sounds like 7 based on your information.  So he does not meet the guideline with both his and his wife’s combined income?

Thank you for your comment. Their combined income is $87,400. So his wife should send her w-2 or 1040? Or we should not count his wife because she is working?

His wife should fill out an I864A and include the required evidence for that form since she is a household member contributing her income to her husband's, your co-sponsor's I864.

Hello again.. Im still trying to fill out the I-864. So my wife's income isn't meets the limit. My brother will be my sponsor. He is married and has 2 kids. He doesn't pay taxes for his wife and his wife is working and her physical address is different than my brother. Can we type "0" to part 5 section 3 " " They're married but they're paying taxes separately.

Your wife is the primary sponsor.  Your Brother is the joint sponsor.  The requirements are the same for both the primary sponsor and the joint sponsor.  

 

I would study the instructions:

Form I-864, Affidavit of Support Under Section 213A of the INA (uscis.gov)

your brother needs to fill out I 864 to be joint sponsor

It's important joint sponsor understands what it means to sponsor u

and he needs to sign the form and get his IRS transcripts (u can't do this for him)
