LPR going back to US

I'm an LPR since 2016, have worked in the US for less than a year, then shifted to being self-employed ever since. Had a trip of less than 6mos outside US.

Fast track to 2019, I needed to leave the US to take care of my grandma.

Entered US 2021 (1yr 8mos), had a re-entry permit, and got through smoothly. After a week/7days, I had to leave the US again to take care of my grandma. Before I left, I filed for a re-entry permit.

2022, I was notified that my re-entry permit was denied (My biometrics was re-used though), it's because I left the US before it was processed.

2023 about to enter US next month (1yr 9mos).

I have filed my taxes religously all years, planning to bring my latest 2021. Greencard is valid still. Dont have Re-entry permit. Have an active US bank account. Brother and mother both US Citizens. Will stay in the US indefinitely.

 

A bit worried here. need your insights thank you!

My advice: Enter and IMMEDIATELY file an N-400.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You have to be admitted into the USA. 
 

Refuse to  sign I-407.  You have good evidence. 
 

Worse case you are admitted as an arriving alien and given an NTA.  Your evidence is good and you will probably win at trial.

I think N-400 will be rejected because OP broke continuous residency

Thanks, I'm really hoping to be admitted as a returning LPR instead of an NTA! My wife is also coming with me, she will be entering her first time as an LPR. I petitioned for her. Flight is very soon. I hope all goes well and I just enter and be greeted the usual "welcome back". Will  stay indefinitely now.

 

I also am a long time VJ member but cant retrieve my original account. Had a couple of questions answered way back when I was still being petitioned!

Ohhh. This got complicated fast.  
 

I don’t know what happens if you get an NTA and she has an immigration visa. The DIY approach suggests to be you should  enter first. If you  are admitted as returning resident she takes the next flight. Otherwise you talk to a lawyer.

This is well noted and understood. Do you think I will likely get an NTA? Really just hoping for the best now.

Best option would be to fly separately (you first), just in case.
