Hello everyone,

 

Me and my fiancé have filed for a K1 visa at the end of July 2021 so it shouldn't take too long until the visa is processed.

The main issue is that she might not be earning enough. However I have a remote job that permits me to work from anywhere and the money isn't bad. I would still be required to pay taxes in Spain for 6 months, and hopefully that would be enough to get the work permit and after that pay the taxes in the US.

 

Would the fact that I already have a stable job with good pay help her out in that regard?

K1 has many issues including a gap when you can not work, presumably that is ok?

No.  You are not allowed to work at all inside the US without a valid Employment Authorization Document.  If that is important to you, then maybe a K-1 was not a good choice. Hopefully, that is a subject you both discussed before filing the I-129f.  Living in the US is expensive.  Good luck on the rest of the journey.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You won't be eligible to work without a work permit, even remotely.  That is a drawback of choosing the K-1 over CR-1 - you would have had a green card straight away.

 

Your USC fiance may need to look at getting a better job, or a second job to be able to sponsor  you for the visa as well as for the adjustment of status.

While I'm sure many people get away with working remotely while they don't have an EAD and are not allowed to work yet, you definitely can not use your job to meet the financial requirements. You would be telling the consular officer that you plan to work without work authorization. Not a smart idea. Your fiancé will need to increase her income, use assets, or find a joint sponsor. Keep in mind that a higher income level will be required for AOS, so if you are already struggling with the I-134 the I-864 is going to be an even bigger problem.

My local Supermarket has signs up for months offering starting jobs at $18 an hour, so does the nearest WallyWorld. Judging from the staff as long as you have a pulse you are good to go.

 

18x40 say times 50 well that is a LOT more than the sponsorship requirements.
