Last year, I had an interview at the US consulate in Montreal for the DV Lottery. They placed me in administrative processing and requested that I complete Form 5535. My administrative processing was concluded, and I was cleared at the beginning of September. They then emailed me instructions to mail my passport for visa labeling. However, upon delivery of my passport, I was informed that the visa quota had been reached, and there were no visas available for me.

My question is whether the administrative processing I underwent for the DV Lottery could apply to my EB2-NIW interview scheduled for May 31st? Alternatively, is there a possibility that I may be placed under administrative processing again?

Hello can you please tell me when was your interview date in Montreal last year? You cleared in September but when was your interview?

A friend of mine who is born and raised in the UK and we both got our PhD in IT from Canada was put in AP too. The officer told them holding a doctorate degree in STEM fields raises a security flag in their systems automatically which is insane! 

I speculate that's what is happening to me too, and other candidates with the silimar situation

You can login in here (https://ceac.state.gov/ceac/) under immigrant visa or use the Case Tracker app. I like the app as you get alerts about important topics and can pull down on your NVC case to get a quick check of your case.

Yeah the ceac website is the best place to check. However, until they issue the invitation it will just say 'at nvc' they don't give any further information than that.

I think some people have seen their status change to "ready" a couple of days before receipt of their interview letters.

Seems like your case number was on the high side or your DS-260 was processed late. So they did conclude the AP/DS-5535 in a matter of 3 months which honestly isn't too bad. Good luck with your EB2!

I have a medical appointment for EB2-NIW. I had a surgery (ACL ligament) on February 2024. Should I tell this to the doctor? If I say, does it affect my application?

Never lie. 

 

But it might not come up. They are really looking for current medications and infectious diseases/ vaccines.

 

There is a possibility they ask about previous surgeries which you would have to mention it. Or unless you are currently still on medication. I do not think in anyway it would affect your application. I got mine done in 2019! I hadn't even considered it an issue.
