I meant.......    why not just return to Britain and do the IVF over there.

Sounds like there is a long story, maybe a complicated one. He could have adjusted either way but that no longer matters.

 

Back to the topic a LPR can file for an expedite.

Oh sorry I didn't know that is what you meant. To uproot our two year old (who is also an LPR) back to UK after settling her into school here and after 6 months only is not something I can consider. With no job for me also in the UK. 

That thought hadn't crossed my mind but it might cross the mind of USCIS.

Right, particularly as their mindset on pregnancy itself is that it is usually not a valid reason for expedite.

OP is a LPR so the INA 245(c)(4) adjustment bar would have applied. https://www.uscis.gov/policy-manual/volume-7-part-b-chapter-7 "Visa Waiver Programs"

In my experience, they usually ask if you've contacted another senator/rep for help with your case. So, starting with one first makes sense.

OP, though you're allowed to request an expedite, I'd be very surprised if you would get one on the grounds of wanting to do IVF, particularly since you're not a USC.

 

There is no national interest, health/medical or financial component to your situation.

They are advertising for blood here, mine is not good enough.

Neither is mine.  I lived in the UK 1987-88.  Maybe they'll look to reversing that deferral with things being so critical.  I used to donate every 3 months without fail.

The process is elective but it is not by choice that I need a C-section, it is due to health factors. Neither is it elective to do ivf, again for health reasons. If I fell pregnant now naturally without ivf the baby will still need to be delivered and the only method is C-section. Elective is just the term they use and it really causes problems. I’d rather not need ivf and I’d rather deliver naturally. 
 

I have made contact with my senators office and they have been very responsive, immediately and said they will get back to me soon. I can’t ask for more than that. 
 

Miracles do happen, I am ‘cautiously optimistic’ 🙏

Well, becoming pregnant and having a baby, by whatever means used, is in fact “elective.”

Ivf and fertility treatments in general are more expensive in the US than anywhere else in the world that I know of. There are a limited number of states that mandate some infertility coverage (11 states?). I don't know of any states that cover more than a few IUI and 1-2 IVF rounds and you may need more than that in your mid-40's. Starbucks has an infertility coverage option even for part time employees kn all states, and I think Lowe's does too - up to a certain amount. I think it's usually enough for testing and one round of IVF but may vary.

 

I know of many people who have flown to the Czech Republic, Mexico, Greece and Spain for a much much MUCH lower price and shorter/nonexistent wait, even with the flights and hotel stays. I don't know what specific issues you guys might be facing, but if you're considering donor eggs or embryos, the Czech Republic on particular has excellent results. Depending on the location in the US and the treatment/testing desired you could be looking at a wait of 6-8 mos or more for a reproductive endocrinologist at a fertility clinic. You will want to check the SART scores for the clinics if you do it in the US, and also check to see if there is a waiting list to get on! Some clinics do telehealth and will let you send in tests from outside the clinic to get the ball rolling.

 

You might consider looking into these other locations.. I can't speculate much on the expediting part other than that I'd be surprised if an expedite for an elective surgery was approved when it is widely available (and even more successful) in other places. Also, even if the expedite were approved you may not want to wait even that amount of time. Unfortunately any method of trying to conceive a child is indeed considered elective by insurance companies, though they will sterilize for "free". ;(

 

Also (question for others, not necessarily OP!) can congressmen and women expedite this process? I thought they could ask for status updates only..otherwise wouldn't they be barraged with expedite requests and accused of favoritism?
