Hello Guys,

 

So i had just done my Interview for my N-400 naturalization application and the interviewing officer asked if i had registered for the selective service when i got my first green card as i was in the age range to register when i got my first green card but unfortunately i didn't and haven't register till today. 

 

Now i am 29 and i had gotten my first green card when i was 23 so now they want me to go get that before they can schedule me for swearing in i assume cos i asked the officer if i would go through another interview but she replied and said no that all they need is for me to send the registration confirmation from the selective service to their Baltimore office where my case is been processed and the rest will be taken care of. I never knew i had to do that immediately i get my first green card as i thought you can only do that when you become a citizen. 

 

So now my question is are these people at the selective service going to have me registered or are they going to deny my request to join? I didn't do that intentionally as i do no know i had to do that cos now my naturalization is pending and i am in a state of dilemma right now. Please guys help with your advise or thoughts on this and what you think i should do to get my citizenship. I've been married for 7 years now and this is more like a long journey for me.

There is no SS registration after 26th birthday.
 

Two choices:

 

1. Try to register and it will provide you a letter or a note saying you are not eligible due to age. Provide that letter to uscis field office along with your sworn statement on why you didn't register before 26th b'day. If they accept your explanation, all good. Chances of success: < 1%.
 

2. Apply for naturalization again after your 31st b'day: Chances of success- >99 %.

If you look at an I-485 it says USCIS will register you with selective service.  Thus if you are not registered the failure can be placed with USCIS and you did not willfully fail to register. 
 

Did you have an ssn when you filed I-485?

Oh wow i didn't know that or couldn't even remember that. i don't think i had SSN when i filled my I-485 cos i filled them all together. I got the EOD and then followed it up from there. Got married and then applied for adjustment of status after which they sent my EOD to me so i don't think i had SSN before applying for the i-485

Follow instructions to get a status information letter.  
 

https://www.sss.gov/verify/sil/

 

Indicate that per the I-485 you signed you expected USCIS to register you and that at the time you did not have an SSN.  Keep two  copy of that letter.  When you get your status information letter, give a copy of it and the letter you sent SSS to USCIS.

Thank you so much mike. So does this mean I have to or don’t have to go through another interview? Once I get all the letters and documents ready and sent to USCIS would they review and call me for swearing in or what??? Just curious what the next step would be. Thanks again for your advice 🙏🏾

I would be sending these documents to field office that interviewed you and if you recall the name of the IO, marked “ATTN: name-of-IO”

 

Or you might get an RFE.  
 

If you get an interview then bring these documents with original and a copy of the status information letter.

Okay got it. Now i am not sure what the verdict will be as the IO actually told me they will send me a mail maybe concerning the interview but out of curiosity i am wondering if the status of my case will be a denial or RFE. Any idea or thoughts on this? I will do the needful for now and keep you guys updated on the progress of the whole thing.

I expect you will get an RFE and an opportunity to rectify before you get a denial.

@Mike E  I had called the Selective service and they confirmed that i was registered but didn't have my SSN on file which made it difficult for USCIS to confirm that. So the changes have been made and my SSN is now updated on file. I went in to verify my registration and all seem and look good so i will have that printed and send it along with other necessary documents. Thanks for your help and advice in all!!!

I was just going to say to call them. My son was registered when we were doing our AOS from K1 and K2's heck they registered him before he even turned 18 or approved our GC. Like you no SSN was used with registration but we did get a card in the mail. THat is how we knew he was registered. He lost it and had to call them as with no SSN we could not do it online.

 

I'm glad they found you and are sending out the info you need to get this finished.
