Hi I sent in my package on Sep 1st. I recently saw in other posts that when people don’t have any lease or mortgage, they ask the property owner to write them an affidavit. I totally forgot about getting an affidavit from my mom who allows us to live on her property for free. However, I did send the renter’s insurance. So my question is will I get an REF since I didn’t submit an affidavit? Thank you!

I don't think so , do you both driver license have the same address ? health insurance , dental , etc.. I guess whatever will work ..

Sent originals... somewhere in the instructions or filing tips it actually says they want originals of affidavits. I know because I had the same question.

Yes, we do have the same address on our driver’s licenses, as well as all the insurance policies and utility bills. On a separate note, I also sent the old apartment lease (with both of our names on it ) before we moved to live on my mom’s property.

Good one, I guess I will ask friends , after writing the affidavit, print 2 copies ,  sign and notarize the two with hand signature and notarize both as originals :) wouldn't that be great , so I keep original one for  just in case and send the other one with the package .

The affidavits are not really necessary, unless you feel your evidence is weak. I think our evidence is pretty strong, but we're sending two, only because a couple of family members wanted to write them for us so, why not?  They don't need to be notarized. With the K1 visa and AOS, we have never had them notarized and never had a problem. Do send the originals, though, and do keep copies.

I am still a bit confused about how the RocketLawyer Affidavit of Name Change works and I was hoping to ask for more help on filling it out so that I don't encounter issues when travelling using a passport from my country of origin which has my previous full given name and surname on it (see Philippine consulate advisory on name changes for married women):

  1. Would you know who the Applicant is and who the Affiant would/should be? If the Affiant is someone else, is quantity better than quality? 
  2. Do these Apostille Convention advisories by the Consulate and by my state of residence (KS) mean I can just go to any notary public here in KS to get the same Affidavit of Name Change notarized? And will I still need to have it authenticated by KS? If yes, how long does the authentication take in these pandemic times? There is an older notarization/authentication advisory pre-accession to the Apostille Convention on the current consulate website that is still active and is more immediately visible. 

Keeping my fingers crossed that anyone from the Philippines or from a country where long given names are still in fashion can answer my questions if Joyoussinger can't. Also, folks in KS who have done these before would be greatly appreciated.

I can't answer your questions, but I can help a little with RocketLawyer. Create an account. In the search bar type: Affidavit of One and the Same. I think their form for Affidavit of Name Change will also work. It's pretty easy. You will be asked pertinent questions and the form will be filled out based on your answers.

Hi all! I guess we're ready to jump back into the immigration stuff after a 2 year break! :)

 

I noticed that USCIS allows for I-751s to be submitted online. I see that everyone here though has submitted via mail. I'm going to send ours by mail as well but does anyone know any advantages of submitting it online?

I-751 cannot be filed on-line. Welcome to our little group. Good luck!

I (the USC) have owned my house, and the mortgage has been paid off, for many years before I met my husband, so there is no lease or mortgage, and I have not put him on the title. I have, however, put him on my homeowner's insurance as a covered person who lives in this house. I'm also including a brief explanation of this in my package.

Hello Everyone,

 

My wife and I submitted our documents to where USCIS received the packet on August 31,  2021.  They sent us back our packet with a rejection notice.   In the rejection notice they stated:

-We are returning your I-751 joint petition and any relating fees as your I-751 joint petition was received prior to the 90-day period immediately preceding the expiration date of your I-551 card. 

-Please ensure to complete the application fully, submit the appropriate fees, and include all required documentation.

 

Technically her 90 period didn't start until September 4, 2021, so we are a few days early.  Do you think they really sent it back for this closeness?

From what I can tell, I believe that our packet is completed.  We followed what USCIS and Visa journey guides when completing the packet.

 

I've tried to call the USCIS, but this new voice automated system and EMMA is just HORRIBLE!  I can't get ahold of a human.  I want to know when we resubmit, do we need to send new copies of everything (USCIS has printed the tracking stuff at the bottom of every page)?  Can we reuse these money orders?  Someone wrote on them, but never cashed them.  Do we need to make a new i-751 form since the date originally signed was in mid August?

 

I feel like I should just make a new cover letter and resend the packet, kind of annoyed.
