Thanks for your updates.  Everytime I see a denial, my heart hurts.  The couple has waited 15 months just to see a denial.  I don't know how a relationship can survive this.

If it gives you some peace, those denials are only for people who "misrepresent themselves." AKA lying. Its typically when someone didn't actually meet within the last two years and either passed it off like they did or tried to get a waiver. It can also occur when both parties are not legally free and able to marry. Either they are still married to an ex without an official divorce (religious divorces and annulments don't count in the eyes of the U.S.) or they are not able to marry yet due to the wait times post-divorce in their state.

 

If you didn't miss any steps, you'll be okay!

The denials could also be for I-129F petitions for K3 spouse.  USCIS routinely closes those in favor of the couple's I-130 petition.  Most I-130 petitioners who file I-129F know that it will be denied/closed anyway, but hope that it will nudge USCIS to process their I-130 sooner.  It doesn't hurt the I-130 cases, but it adds to the workload of USCIS, taking up time that could have been used to process I-129F petitions for K1.

Weekly Update (Ran 1/6/2023)

Not really anything happening in my group (December 2021) still.

We had a couple of denials and termination notices but nothing really to report for December.

 

For the rest of you, 468 Case updates is a dramatic improvement over last week but still slow.

A couple of untouched cases seen as acted upon in November 2021, but sti;l quite a few cases 
untouched dating all the way back to Aug 2021.

Hopefully, we will see the pace picks up again now that we are into the new year.

Agree uscis not doing their job and sending in a huge amount of rfe or keeping people waiting 15+ months and also denying is bad. They need to be sued and held accountable.

this makes more sense thanks for the clarification.

Wow starting to feel left behind now. Still close to 300 cases in August they really should finish prior cases before opening new ones. It's such a mean thing to approve 60-80% of cases and leave 20% in limbo. Without there being any issues since the cases with issues would be in Vermont not in california...

maybe a way to further stretch processing time formula?  regardless,  very very sad for sure

Just got approval after responding to RFIE on Nov. 29th. Sent in a case inquiry two days ago (the earliest they would allow me to) hoping it would get them to look at my case again and it worked.

Approve as in for NOA2??  Interesting.  I thought you have to wait 60 days after RFE is received to sent in a inquiry.  I'll try sending an inquiry soon then also!

Yes! I thought I would have to wait the 60 days also..it could also just depend on what the RFE is. Definitely worth a shot.

What was your RFE?  Mine was intent to marry.  I submitted the forms I seen on Visa Journey, but the RFE states that wasn't enough.  I needed engagement ring photos, text logs, how we first met,  wedding plans, and additional proof of our relationship.

 

It was weird as VJ forum recommended against submitting this stuff.  Though, the RFE asked for all this.

Has anyone here submitted an inquiry for 'outside of normal processing time'? It says I can inquire next Friday but I am thinking of inquiring sooner. Today is day 497 😥

I don't think it  will let you inquire until the date it gives you. I've tried several times already lol. I'm curious to know if anyone has sent in an inquiry what happened after, was an approval or response recieved quickly?

I'd wait until it is "officially" time to inquire ...

Wishing you the best of luck in getting this resolved (and sorry that you had so much of a delay with them)
