Hello, I would like to bring my wife over to the USA while I apply for a outland sponsorship application for Canada. I would optimally love to have her for 1 year, but I understand 6 months is basically the limit. She goes through a lot of emotional distress being away from me and I would like to be with her as much as I can. Is there a visitors record she can apply for after her 6 months? Thank you.

No

Okay, thank you

You can apply for an extension on her b2 visa but it must be applied for atleast 60 days prior to her expiration of her stay. If she doesn't hear anything by the end of the 60 days then she must leave the United States or it's considered an overstay.

She must be in the United States when you apply for extension.

Wow! That is really good news. Thank you so much for taking your time and explaining it to a layman like me. Does that mean I should apply much earlier than 60 days, just in case it takes a long time?

It is recommended 45 days but this is precovid for that. I'd possibly even do 70 days to stay on the safe side, but I think 60 should be enough prior to expiration of her I94. With Canada having a required hotel stay and isolation period it may be granted for a longer stay since traveling back and forth from Canada to USA is much more complicated now and costly.

I would also recommend to be prepared if they object and she must leave at the date of her I94.

I'd also apply for the CR1/IR1 visa as soon as you can if you haven't yet as the wait will be a long one. Which she'll have to be in Canada for certain things for the visa.

When my wife entered last September she told the IO she might need to stay longer than 6 months. (Not something I would have advised her to do but we were apart going through immigration.)  Anyway, he told her to extend her stay she needed to apply for the extension within 90 days.

Wow!  Your wife was lucky CBP even let her in.  Or maybe because of COVID and frequent flight cancellations, they've been more understanding of changing plans?  On one of my trips pre-COVID, I told the CBP officer I planned to stay for 30 days.  He asked, "Why are you staying for so long?" 😔

Yeah, I cringed  when she told me that but this was about her 6th entry over 11 years. We're awaiting her interview so we don't have to deal with that anymore.

Be very careful.  If she stays more than 180 days then she will be a resident for tax purposes and will likely lose her provincial health care.  Pop over to the Canada forum for more specific answers.

Good luck
