Getting married abroad AFTER getting married in the United States (k-1 Visa)

Hi All!

Can I marry my fiancé abroad AFTER we get married in the United States on a K-1 visa and AFTER filing form I-485? There are lots of comments on here about NOT marrying abroad BEFORE marrying in the United States because this would invalidate any pending K-1 visa petition/process. But if we get married in the United States first and then travel abroad after receiving a travel document via the I-131 petition that was filed at the same time as form I-485, can we get married abroad while waiting for adjustment of status in the United States? In other words, we'd be married in the United States first and while waiting for permanent residency status would get married abroad. Any comments/suggestions are appreciated. Thank you!

Your plan is fine.  That is the recommended process.  The second "marriage" is a ceremony, and not a marriage. There would be no impact on US immigration.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You would not be getting married again as you can only marry once.  You can have a celebration of your marriage or something akin to renewing your vows.

It would simply be a ceremony for your family and friends, since you'd already be married.  The travel document is taking around 8 months on average.

I know NY allows you to get married twice, now what the complications are well that would need competent legal guidance.

If the place you are getting married at the second time allows you get a civil marriage license and marriage certificate, my advice is that you treat those documents as souvenirs that State and DHS never sees.  Otherwise you risk unnecessary confusion.  Keep it simple.

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
