I wish to bring my mom who is currently in the Philippines to the US to be a permanent resident. I have a few questions:

 

1. What's with this travel ban made by Trump? Will that currently hinder my petition (I-130)?

2. How long does it usually take for her to get the visa?

3. What is the outline for entire process and what are the documents needed for the entire process?

4. I assume there is a medical exam required for her to pass. Where is it and how much?

4. What is the estimated total cost?

1.  The ban on issuing visas will expire March 31, 2021.  The ban will not affect your mother.  You can file the I-130 today.

2.  12-18 months from filing the I-130 to getting a visa interview.

3.  VJ has a Guide.  You can follow it.  Be sure to read the instructions for each form.

4.  The medical exam can be scheduled after she receives her interview letter.  Others can tell you where in Manila and how much it will cost.

5.  Approximately $1500 to $2000.

@TripleJRobinson I didn't realize you had posted similar questions in two separate threads. Please keep your questions on the same topic in one thread so that the mods don't lock your threads.

 

To reply to your other question, seems to me that a tourist visa is more appropriate for your mother. She's not decided if she wants to move permanently to the US.

 

if the tourist visa is granted, it can be valid for as long as 10 years. However, that does not mean your mother can stay in the US for 10 years straight. It just means she can travel to the US in that 10 year period.

 

Each entry to the States is subject to CBP and, on each entry, CBP will determine exactly how long she is authorized to stay (can be as long as 6 months).

 

Your mom can apply for the tourist visa when the US embassy in Manila opens, try visiting you, decide if she likes the US enough to live there, then, when she's completely decided, she can apply for an immigrant visa and you can sponsor her.

The following is extremely rare, but the max possible amount that the CBP officer can allow is 1 year: https://fam.state.gov/fam/09fam/09fam040202.html "If such individuals plan to stay in the United States for more than six months, you should advise them to ask DHS for a one-year stay at the time they apply for admission."

When the US Embassy starts accepting visitor visa applications, try for that first.  It's $160 and is a quick process.  If she gets visitor visa, great, she can come to visit.  If she is deny a visitor visa, then you can consider filing an I-130 since the cost is $1500 to $2000 and takes 12-18 months.

Greetings!

I hope this helps. It is more or less like how your immigrant visa was processed with a slight changes as time passes. Just make sure to read USCIS for some updated changes.

1.       President Trump's Proclamation Suspending Immigration - National Immigration Forum

Note: I am hoping that it will be lifted this March 31, 2021. 

2.       After the initial application up to her interview. It was 6 months from our experienced.

Provided that all documents are correct and completed and Fees are paid. Also, when you are fast enough to follow up and respond to NVC fees and all required documents needed. This time it may change a little bit due to this pandemic.

3.       The initial filing will include documents like Form I-130, NSO birth certificate (mom), NSO Marriage certificate (mom & dad), NSO birth certificate (yours), Proof of you as a US citizen, maybe US passport or Citizenship Naturalization Certificate.

May read VIA USCIS I-130 INTRUCTIONS ONLINE FOR COMPLETE LIST.

4.       The current medical fee at this time is P17,025.00 plus P4,300.00 for the RT-PCR Test (COVID related), three days prior to your flight to the USA.

5.       Estimated Cost:

a.       $535.00 initial filing fee for I-130. Once approved, It will be sent to NVC and you will have to pay the following fees:

b.       $120.00 AOS fee processing fee to NVC.

c.       $325.00 IV Immigration fees to NVC. Once you paid all NVC fees and submitted all documents and that you are approved or documentarily qualified then your mom will wait for her interview appointment.

d.       Once she has her interview appointment then she can schedule for medical appointment. ) P17,025.00 plus P4,300.00 COVID r/t testing fees.

e.       Interview: This guide may help you.

f.        Visa delivery.

g.       Hotel stay if not from Manila.

h.       Flight Fares.

OP can still file the I-130 right now. The Proclamations are only about "entry." Multiple federal courts have supported that position. See Gomez v. Trumphttps://casetext.com/case/gomez-v-trump-1 "The Proclamations solely address the entry of immigrants and certain nonimmigrants into the country; they say nothing about the issuance and adjudication of visas. And the statutory authorities cited in the Proclamations also address only entry, not visa issuance. See 8 U.S.C. § 1182(f) (empowering the President to "suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate"); 8 U.S.C. § 1185(a) ("It shall be unlawful . . . for any alien to depart from or enter . . . the United States except under such reasonable rules, regulations, and orders, and subject to such limitations and exceptions as the President may prescribe.")."
