Hello Everyone, US Citizen has filled / submitted a case for his son who is not in USA and "over 21 but unmarried". Received the Notification for i-130 form receipt # on 22nd August, 2019 which has the details of how to receive updates via USCIS online account. Online account is active but there are no updates so far - Case History tab on the USCIS Portal shows "Invalid date Case Was Received and A Receipt Notice Was Emailed".

 

Can you please share what happens next and when? How long does it take to get an immigration or what would be the next steps in this process. Do i need to contact someone or if the process is on hold due to COVID or change in Govt? Please share details. Thank you

Once you get your reciept, depending on which service centre it will take maybe a year or more usually before getting approved, with covid this could be even longer... once approved USCIS will send you an approval notice and forward the file to NVC.. NVC will email your son to upload more forms, docs etc... 

 

check case processing times for your service centre if it’s outside of times you can submit an online enquiry

Nothing to do until the priority date is current.

A US citizen filing for an unmarried son over age 21 is an F1 case.  The current wait is about 7 years for an immigration visa.

 

Once USCIS receives the I-130, the petitioner gets an NOA1 receipt.  It can take USCIS anywhere from a few weeks to several years to approve the I-130, and there is nothing you can do to hurry this up.  You will not hear anything until USCIS approves the I-130 and forwards it to the NVC.  At the NVC, the approved I-130 will sit until the Priority Date is current in Table B of the monthly Visa Bulletin.  Once the case is current in Table B of the Visa Bulletin, then the NVC will contact the petitioner to pay the DS-260 visa application fee and I-864 Affidavit of Support fee.  Once all the documents are filed and the PD becomes current in Table A of the Visa Bulletin, the NVC will schedule an immigrant visa interview at the US Embassy/Consulate.  

So next 5-6 years or so, you will only hear from the US government when USCIS approve the I-130 and when the NVC starts processing because the Priority Date become current.

Thank you for your detailed response :) There is still a confusion if you could answer. I have an account on USCIS portal. The case status on Feb 23,2020 was "In process - Your benefit request has been accepted and is under review" however now the case status is "Case Was Received And A Receipt Notice Was Emailed" & Case history "Invalid date Case Was Received and A Receipt Notice Was Emailed". 

 

I am not sure why they accepted it earlier and now status is different. Do you think i should raise a question or should i just wait. Please note the case was filed on on August 22, 2019.

Good Morning - Two quick questions regarding I-130 Petition for Alien Relative. Please share your thoughts. 

1) Case submitted y my father back in 22nd August 2019 for unmarried son over 21 years and account acceptance notice received on 27th August 2019 . My father passed away on 7th Nov,2022. Case is still pending. Please confirm if case will remain active or not. Is there any way to complete the process or will USCIS consider my case not eligible because i am still in home country.

2) If I apply for visit visa to visit my father's grave, will it be granted or not.

I am sorry for your loss

1.. Petition is revoked on death petitioner and cannot be reinstated.https://www.uscis.gov/green-card/green-card-eligibility/humanitarian-reinstatement

2. Humanitarian parole may have been considered  to attend  funeral , but definitely not to visit the grave .

Basic Eligibility for Humanitarian Reinstatement

You may only request humanitarian reinstatement if you are the principal beneficiary of an approved Form I-130, Petition for Alien Relative, and your petitioner relative has died. We cannot grant humanitarian reinstatement if the petitioner died while the petition was pending.
