Currently in the US with B1/B2 visa to visit my partner, but the Immigration at the border told me not to get married during this trip because he will note that on the system

1st visit: Feb to March 2020

2nd: Nove To Dec 2020

 

This is my 2nd visit here, on my 1st visit everything was perfect and smooth. For my 2nd visit, I planned to stay for 9weeks but the officer bombarded me a lot of questions and ask me are we planning to get marry on this trip. My answer is NO because there was NO plan at all because Im just here to spent holidays with her, i was not sent to the interview room. I was able to proved that I have ties like work and properties back in my homeland and will return as scheduled. Unfortunately, after 2weeks my partner just proposed to me because finally her parents understand the kind of relationship that we have. The finally accepted us! I already told her the dilemma that I encountered with the officer that this might cause trouble. The question is are we not really allowed to get marry during this trip? Can this cause problem if she intend to petition me afterwards? 💔💔

You are allowed to marry, if you want. What the officer said has no weight after being granted entry. For example: https://uk.usembassy.gov/visas/immigrant-visa-faqs/

We are traveling to the United States to marry and will return to the United Kingdom after marriage. Do I still need a fiancé(e) visa?

If you will return to your permanent residence you may apply for a tourist B-2 visa, or if eligible, travel visa free under the Visa Waiver Program.  At the time you apply for the visa and/or travel to the United States you will be required to show that you have a residence outside the United States that you do not intend to abandon. There is no set form that this evidence takes as it varies with each person’s circumstances.

Getting married is a perfectly legal activity when you are here on a B-2 visa. I have no idea why you would get told not to get married. It’s a free country. Assuming you meet the requirements to marry here (are old enough, are not already married to someone else or locked into a specific waiting time following a divorce, are not related in a way that makes marriage illegal) then there is nothing to stop you getting married.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

I was making about 4 trips per year to Philippines, each time I started coming back after about 10 trips they started sending me over to some type of secondary. They would make me open my luggage and they would rummage thru it, they would have me empty my pockets, and they wanted to check my camera back then for pics.  I would sometimes have luggage and some trips I would have carry on.

 

Finally I got feed up with them always jacking with me, When they sent me over to open my luggage, I said I am not going to do it, if you want it open you open it.  You want to search my pockets, then you search them.  Finally they stopped taking me to secondary luggage inspection.

Thank you! But the officer really insisted that marrying during this trip might affect the petition process, because I said to him that We got no plans initially. Its just that NOW my partner was really happy about the outcome of coming up with the parents. But as of the moment Im still terrified with the words of the immigration officer. ☹️

Don’t worry about it. I got married whilst visiting and left as normal at the end of my visit. Not an issue at all.
