Embassies are beginning to open and processing K-1s. In my opinion it will be just a little more time before they get to your record with the backlog they have. Also, consider that if you have had an interview and your case is stuck then this lawsuit could help you but if you haven't even had your interview then this is not going to have a affect for you since the embassies are already beginning to process K-1's again. But it's your money.

 

BTW this is already a thread on this topic. That's where a question like this should be a part of. Just saying.

Timeline

Thank you,  will chk the topic. My interview was in march and cancelled due to covid. Madrid embassy isn't rescheduling k1 interviews because of pp9993 ( schengen area ban). That's why I wondering if this lawsuit will help me if i join the lawsuit.

You can always pay the lawyer, a court can't force embassies / consulates to interview any case, it can take years for big case like this to be heard.

I believe diversity visas are more crucial than K-1, it is not even an immigrant visa.

The judge ruled that refusing to do the interviews because of travel bans was unlawful and because consulates are moving forward with interviews for other types of visas,  they are capable of processing the Diversity visas as well.  I don't know the strategy for the K1 lawsuit but I imagine those arguments still apply.

While I agree the impact of the lawsuit may be limited, I think reading the filing was very interesting and showed a lot of the issues K1s are facing. Probably the most concerning to me is the fact that some embassies have stated they will process expedited requests but NVC refuses to pass them on until “routine services are continued.” I know some folks dealing with the Moscow embassy have also gotten this. This makes the “high priority” status of the K1 at the embassy level irrelevant since they won’t even get the application.

Note that it was just a Memorandum Order. It was issued so the merits of the case are assessed later at trial and because the 09/30 DV deadline was fast approaching. The judge's Memorandum Order didn't help the other plaintiffs (F2A, F2B, IR-5, F1, etc.).

 

And the judge made it clear that the DV applicants that get the visas because of the Order still can't enter the US until the April 22 entry ban is over. "Plaintiffs’ requests for the court to preliminarily enjoin Defendants from implementing or enforcing Proclamations 10014 and 10052 against Plaintiffs are denied."
