I left the country a couple weeks ago to take care of some business in the Philippines and because her AOS is in process she stayed behind.  I'm actually still in quarantine until tomorrow even after a negative test a week ago.  The Philippines has been quite ridiculous on lockdowns, and rules on top of rules etc.  There's really no coordination between gov't units and each governor has to add some of their own rules to the Nat'l rules, and then the mayors add some more rules, each to flex their power.  Anyway, I get woken up about 7AM with a bunch of Messenger dings.  The wife is in a panic and says she was "DENIED" and she sent a picture of the letter.  This is particularly bad timing because yesterday marks the end of her 6 month stay on her B-2 and now she's an overstayer if not for the AOS.  The internet here is some of the worst in the world so I can't read the picture of the letter yet.  All I can see is that it's from USCIS. I check the Lawfully app and nothing has changed.  While I would think something that important would update, I don''t know how reliable the app is.

 

Eventually, a higher resolution version of the letter downloads and I see nothing about denial.  It's the I-693 deficiency notice I already saw online 10 days ago and warned her to expect.  Pheewww.  After she (and I) calmed down, I explained they just want her to bring her physical to the interview if she has one.  It's the sealed envelope in her packet of papers so she's already ready for it.  Hahahahaha

 

Man, you had me sweating there... You should write a suspense novel, lol

 

On the other hand, thank God it wasn't a rejection... Good luck to you both.

Timeline

Finally, some movement on my case. Today the I-485 status changed to "March 3, 2021 Request for Initial Evidence Was Sent". I am guessing this is the I-944 RFE as I did not submit the form initially. Nothing else has happened to my case since the initial NOAs.

RoC Timeline:

  1. 12/04/2023 - Application sent to USCIS Elgin, IL lockbox
  2. 12/07/2023 - Application received by USCIS
  3. 12/12/2023 - Received "Your case received" text message from USCIS. Receiipt # starts with IOE
  4. 12/13/2023 - Check cashed by USCIS
  5. 12/19/2023 - Received in mail the I797 with the receipt number and the online access code
  6. 12/19/2023 - Received in mail the bio-metric re-use notification
  7. 12/21/2023 - Received in mail the I797 NoA extending my green card by 48 months

Omg! I am glad that you finally heard something! Good luck on the I944, it was annoying to put together, I recently only sent in mine a few days ago (it should be arriving to them today).  It sucked.

I received my EAD in the mail today! It was mailed out yesterday, so it was a super fast (and unexpected) turnaround for USPS.

09/25/20: AOS package (I-130/I-485/I-765/I-944) mailed out via USPS.

09/27/20: Package received by USPS.

10/24/20: Received NOA1 in the mail. PD is 09/28/20.

01/05/21: Biometrics appointment completed (Brooklyn ASC). Case updated to show fingerprints were taken (I-486 & I-765).

01/05/21: I-131 mailed via UPS.

01/17/21: Received IOE receipt number for I-131 via text.

01/25/21: Received a biometrics reuse notice for I-131.

02/02/21: I-485 Case is ready to be scheduled for an interview.

02/04/21: Received I-693 deficiency notice in the mail (dated 01/29/21).

02/09/21: Advance Parole document was produced.

02/16/21: AP in hand.
02/26/21: New Card Is Being Produced (EAD).

03/04/21: EAD in hand.

09/01/21: EAD renewal paperwork received by USCIS. IOE receipt number.

09/07/21: Receipt / 180-day automatic extension received in the mail.

09/09/21: Received a biometrics reuse notice for I-765 renewal.

10/25/21: AP renewal NOA and biometrics reuse received in the mail.

11/04/21: Interview was scheduled for 12/02.

I wonder if the 944 is something you can upload on the website? Perhaps since that is signed it has to be mailed. I've uploaded a few things like my W-2 for 2020 when that came in.

August 30, 2020 - Mailed out case to USCIS (I-130/I-485/I-131/I-765. I-693 and I-944 not included) (Delivered August 31).

September 1, 2020 We received your Form I-485, Application to Register Permanent Residence or Adjust Status.

September 1, 2020 We received your Form I-765, Application for Employment Authorization.

September 16, 2020 We accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or Adjust Status. Our National Benefits Center location is working on your case.

September 17, 2020 Case Was Received (I-130).

September 17, 2020 Case Was Received (I-131).

September 18, 2020 - Checks cashed.

November 30, 2020 We sent a request for initial evidence for your Form I-485, Application to Register Permanent Residence or Adjust Status. (I-944).

January 6, 2021 The fingerprints relating to your Form I-485 Application to Register Permanent Residence or Adjust Status, were taken.

January 7, 2021 Case Was Updated To Show Fingerprints Were Taken (I-765).

February 19, 2021 - Mailed out I-944 RFE Response (Delivered February 25)

February 26, 2021 Response To USCIS' Request For Evidence Was Received

Looks like things are moving for everyone here. I'm totally loosing patience already. My PD if october 29th because of my initial rejected notices, but still have not heard about anything regarding my bio apt so I reached out to an agent through the online chat, who put a request for me on Feb 25th to the center in charge of my application (so I believe MSC). He said it would move things faster and I would get an update in the next 30 days, still waiting. I have a feeling my process is gonna take years...! 

Under H1B valid until September 2022.

Marriage based AOS Timeline:

  1. 9/30/2020 - Application sent to USCIS Chicago lockbox using USPS
  2. 10/2/2020 - Application received by USCIS
  3. 10/26/2020 - Application rejected for outdated I-485 form
  4. 10/27/2020 - Application re-sent to USCIS lockbox using Fedex
  5. 11/19/2020 - Checks cashed (+ got my receipt numbers through online chat the following day)
  6. 11/29/2020 - Received 4 text messages from USCIS with the 4 receipt numbers.
  7. 12/03/2020 - Received 4 NOAs in the mail.
  8. 05/17/2021 - Biometrics appointment
  9. 05/20/2021 - "Case ready to be scheduled for an interview"
  10. 07/26/2021 - Case approved for my I-765 and I-131
  11. 09/01/2021 - Interview in San Antonio + "New Card Is Being Produced" status right away
  12. 09/02/2021 - "Case Is Approved"

So looks like biometrics for me is going to be more of a headache than I first thought. I went through the live chat today and talked to a tier 1 to see if my appointment was scheduled. Turns out it is and that my notice was supposedly sent over 14 days ago. (Which is weird because I’ve been contacting them at least once every week for the last couple of months). Anyway, she scheduled a tier 2 callback so now I’m waiting. But all in all, very frustrating!

10/20/2020 - Checks cashed by USCIS

10/20/2020 - Received eNotification texts for I-130/I-485/I-765/I-131

Update: The tier 2 officer called a couple hours after and sent me my notice by email. I'm scheduled for March 18. So glad that worked out so quickly.
