Pregnant k1 visa

Timeline

Hi all,

 

I am looking at the timelines due to covid and I don’t think I’ll have my interview date before I give birth in January. We received our NOA1 in April. Looking at U.K. timelines that brings me to about March and my baby will be born by then and I hope to god my fiancé can fly over for that. Will this affect my application as he would now need to apply for the baby ? Just getting very overwhelmed with it all. 
Any help would be welcomed. Thank you

If he has met the physical presence requirements (5 years in the US, 2 of which are at age 14 or later) to pass US citizenship to the child, then he will just need to get a CRBA & US passport for the child. This is not a long process like a visa...typically a few weeks or so I believe?

The only real impact of birth before interview is he will have a larger household size for I-134 purposes.

Would the child qualify as a USC?

But if the BC shows him as the father and he can show that he was around during the estimated time of conception - and being from the UK (low fraud) - then they probably won't ask for it. They can...but I wouldn't expect it in this case.

yeah,  that is why i said the may could have added they may not but figure that is implied

If you have the baby before the interview then you will need an updated I134 that shows income for a family of 3

The estimated time is stated as:

Processing time for a Consular Report of Birth Abroad and First Passport is approximately 4 weeks.

Your documents will be returned to you by either DX delivery service or by Royal Mail once processing has been completed.  Please ensure that you arrange a return delivery and make a note of your tracking number as the Embassy does not maintain this information.  You may use the tracking number to track the return delivery of your passport. This will be arranged on the day of your appointment.

Alternatively, you may bring to your appointment a pre-paid self-addressed Royal Mail Special Delivery envelope with minimum postage paid up to 500 grams. One envelope is sufficient for up to four passports.

Given the costs of childbirth in the US, even for the most uncomplicated of births, it might not be a bad idea that you’ll still be in the UK when the time comes. Touch wood all will be well. But should you require a c-section or the baby require NICU care, you’ll save a fortune.

Hey,

 

I am in a similar situation as you : pregnant and due date is end of October. I am really not sure I will be able to make it on time and will most likely will have to deliver home (which is not bad from a cost perspective but sad to not have my fiance with me for this wonderful time of life).

 

If I have my K1 issued before the birth, depending on when I get it I might still travel after birth if it is too close to my due date and will have a USC passport made for my baby. If i do not have my K1 before birth then I guess I will have to update as mentioned by others.

 

Good luck youre not alone into this messy situation!

Thank you!! Yes he’s us citizen. Okay the form may need adjusting. That’s okay and luckily the passport doesn’t take too long

He was stuck here during lockdown so I think that will be covered. We have lots of pictures in the garden and from our walks.

I did think the same but my fiancé informed me the baby will never be president if it’s not born in the states. I’m okay with that 😂😂
