my i 130 for my wife was denied

i appealed  eoir 29

i got this :

 

On March 20, 2020

 

Thank you for your inquiry. Your case is currently pending review by local counsel to ensure there was no error in the decision on the case. The current review period is six months to one year. Your appeal will be forwarded to the Board of Immigration Appeals once review is completed.

then i got this

 

Your Case Status: Post Decision Activity 

On May 13, 2020, we sent your Form EOIR29, NOTICE OF APPEAL FROM DECISION OF DISTRICT DIRECTOR, to the Executive Office of Immigration Review (EOIR). That office will mail you our decision or send you a request if it needs something from you.

 

what does this mean

where is our appeal?

how long we ll have to wait?

although i dont think the details will make any difference , i am asking about the meaning of uscis reply which is standard and the place where my appeal is ,

but

we were denied as my marriage to my present wife is not considered correct due to my divorce from my ex american wife was in egypt not in court but in registration offices

I would recommend to address the issue and properly get divorce  in the US assuming both of you reside in the US.  Without a legal divorce, you don’t have a chance.


As far as response to appeal inquiry, it means they haven’t made a decision and they will contact you if they need anything.

Where did you marry your previous wife?  All I can see from your previous posts was that you filed concurrently in the US and then later did an I-360.

they r 2 different persons , right?

how come i was told that my appeal will be reviewed by the local counseler which will take 6 to 12 months before transfered to bia

and in 2 months it us transferred

and

is eoir same as bia?

The case was reviewed by local counsel first then sent to EOIR. The EOIR is now reviewing the case and will notify you of whatever decision they make or if they need more info.

Nothing to do right now. Your appeal has not been approved or denied. It's processing still.

I would suggest discussing it with your lawyer.

If you didn't have one, I would personally be worried given the technical aspects of the reason for denial (validity of a divorce is not a DIY argument IMO).

As long as it takes. There isn't really a base timeline given the cases that are handled by them tend to be of varying complexities. Some may be quick and simple. Some may go through rounds of counsel research and feedback.

Timeline

march notice meant local office was reviewing your case 

May notice means it has been sent EOIR for a decision of your appeal (you must have filed an appeal or complaint )

I did an appeal and it took a year for the Immigration board to review and make a decision

the letter says the board will either make a decision and mail you their findings (for or against the appeal) or ask for further proof (RFE) to be able to make the decision

What can you do about this?  wait

or

finialize the divorce and reamarry and reapply

Was the divorce done in Egypt at the   Ministry of Justice offices?      Was the divorce registered with the Civil Office there in Egypt?
