Hi Guys! 

 

So, today - May 1st, 2020,  I received the RFE letter. I wanted to share everything with you and see if you can help me with the preparation of the packet. I want to thank you in advance for your help. You guys are amazing!! 🏆

 

This is what I sent to USCIS on July 12, 2019. Vermont center. 

 

Evidence of our bona fide relationship:
• Copy of our Marriage Certificate
• Copies of our joint tax return for 2017 and 2018
• Copies of our tax transcripts for 2017 and 2018
• Copies of our W2's for 2017 and 2018 showing same address
• Copies of bank statements from our join bank account for the past 24 months
• Copy of our joint account debit cards
• Copy of our apartment renters insurance showing joint policy
• Copy of my spouse's life insurance policy showing my name as the beneficiary
• Copy of our original apartment rental contract showing joint cohabitation
• Copy of our renewed apartment rental contract showing joint cohabitation
• Notarized sworn affidavit letters of support from family and friends
• Letter from the Building Management Office confirming our tenancy and joint cohabitation
• Copies of electricity bills for the past 24 months showing joint account 
• Copy of our Costco joint membership
• Copies of checks that we have paid the apartment rent with from our joint bank account and the landlord's receipts.
• Copy of check that we have paid the IRS from our joint bank account
• Copies of medical records, phone bills, online orders, furniture deliveries, bank correspondence, IRS correspondence, Department of Motor Vehicles, USPS package deliveries, promotional materials and other showing same address
• Copy of an email from a real estate investor in regards to future investments addressed to both of us
• Copy of a reservation confirmation for a United Airlines client event that we attended in New York City showing both of our names
• Copies of Driver's Licence and State ID showing same address
• Copy of our airline tickets from our trip to Chicago, Illinois
• Copy of our hotel reservation confirmation letter in Chicago, Illinois
• Explanation to why we don’t have a joint health care insurance
• Explanation to why we don’t have a joint phone plan
• Pictures together from 2016 to 2019.

 

BELOW IS THE RFE LETTER. They are basically asking for the same things. I don't understand. Compared to other people that I know, who have gotten green cards, I think I have sent more than enough.

Unfortunately I don't have anything additional from what I sent 10 months ago. We don't have a kid, we don't have a car, we don't have a joint phone bill because his company pays for his bill and we don't have joint health insurance because we've been changing jobs frequently and we couldn't be on the same plan. 

Do you think if I send the same documents, but with new dates for the past 10 months it will be sufficient??? AWAITING FOR YOUR ADVICE :))

what about lease agreement? they listed T-mobile bill for your spouse as one of the evidence you sent. well for me, I try not to send any evidence not joint with my spouse. We use same phone company but I didn't include it. I have to wait and see if they ask for more, meanwhile I informed them that we drove to other vacation trips within United States and provided photos only. You can find below, list of documents or evidence we sent to USCIS to verify the status of our marriage and ongoing relationship. I sent it out three days ago.

Thank you @Athens !!! Did you submit this for the initial I-751 or as a response on a RFE

 

I did submit lease agreements and extensions of the lease as well as a letter from the management office confirming our residence and an affidavit from the building's super attendant.  

 

I submitted my spouse's Tmobile correspondence under "other" proof of address evidence just to show that we receive mail on the same address.  I also included a letter explaining as of why we don't have joint cellphone bill (his company pays for his phone).

This is really weird. USCIS is basically contradicting themselves. I can't think of a reason why would they consider what you have sent are not enough. I am also preparing the documents to send, what I have is similar to what you have (But we do have joint insurance etc.)

 

Please keep us updated on how you finally reply to RFE pls! I would like to know what is possible solution if this ever happens!

So far I've been handling my case by myself from the very begging and everything was going smooth. I'm thinking maybe it would be worth it hiring an attorney 🤷‍♀️😑

Yes me too. Since our situation is not that complicated, I have never thought about hiring an attorney.

 

But it is the best that you do since you can't really ignore the RFE even though it is weird and especially you can't really provide more. Maybe a lwayer can probably write a letter of explanation or so, I guess.

 

Do you know if there is a time limit within which you have to reply to a RFE?

Meh, I tend to take RFEs like this for ROC more of a "it's been a awhile...send us anything new you have before we make a decision" type of request. They want to make sure you're still together and let you send anything else you have, not necessarily that what was sent was actually insufficient.

 

If anything is lacking, I would guess it would be showing evidence of shared responsibility for accounts and debts. It looks like you provided evidence of 2 shared regular household bills + statements showing some other bills were paid via it. Do you have any other shared accounts? Other utilities to add? Something that shows actual joint ownership, not just usage, of the accounts?

 

Again, I wouldn't worry too much.

Timeline

It could be they are about to approve your ROC without interview and wants to know if you are still together. Send them documents gathered since you applied for ROC because you can’t give what you don’t have. It’s better to respond with a cover note explaining what you are sending if not sufficient. I believe you will be called for interview if not enough.
