Please see the attached scan of the Notice of Action 1: AoS In-person interview. Underlined in red, it states we must bring a letter of employment for our in-person interview.

Now with these (unless already submitted) do I need to do it again even though I sent it in the AOS package?

I wonder if the office will end up a mess and unorganized and everyone somehow lost everything again.

I don't know if it varying state to state, but here in Mississippi Walmart, Kroger and other store chains are begging for temp workers during the pandemic. They are hiring on the spot more or less. Just something to consider OP.

You must have submitted an I 864, they would never have let you pass with an I 134.

Correct. We submitted an I 864 when we submitted the AOS packet, but I was never asked a single question about income or my job at the interview which was about a year after submitting the AOS package.

I think the issue was you said "We had not shown anything regarding income since the K1 interview in my husband's home country a year before".

The I-864 + supporting evidence was shown/presented (even if not at the interview - it is something they reviewed).

My wife and I were not asked employment or income questions at the AOS interview either. But I do know of cases where it was asked. I can't say if it's more likely than not to be asked or not asked...hence the suggestion to be prepared either way.

I remeber being asked, I thought the interview started with being asked to reaffirm the information supplied was still correct? However I will not swear to that, nor would I assume that all interviews follow an identical pattern.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

In my original post, I said I had not been asked anything at the interview in response to the previous post about how some people had not been asked anything in the interview (which included myself). I meant I had not shown anything in an interview setting or in person since the K1 interview. Sorry, that could have been easily misconstrued so thank you for bringing that to my attention. To clarify, I was asked about my income at the K1 interview since I attended it with my then-fiance. When we submitted AOS, I included all the information on the I 864. My income had not changed too much, just a small raise. At the interview itself, neither of us were asked any questions about income and no one looked at my tax forms or updated I 864.

I may be wrong, but isn't that for your sponsor's current employment, not yours? I would presume your significant other has a job (or you already have a sponsor) so your income doesn't matter in the grand scheme of things. The point of the I-864 is to prove that your petitioner / spouse (or other joint sponsor) can and will support you if, for example, you lose your job and can't support yourself.

From how it was explained to me at the embassy for my K-1 interview, USCIS does not care about your income since that can easily disappear and there's no recouping the losses from the government providing you with benefits. But, under the I-864, your sponsors are liable to repay any means-tested government benefits you claim. If you have a job, great, that's a huge mark saying you won't become a public charge. Having held a job is a lesser good mark, but still a good mark, since it shows you can be employed in your field. But, otherwise, it doesn't matter so long as your sponsor(s) can support you, though losing your job really sucks :(

(This is just reading it as it's mentioned on the AOS interview notice and from experience. You absolutely should consult with an immigration attorney if you're seriously concerned about this.)

EDIT: Actually, going back through it. If you're the sponsor and it's your wife that immigrated, then you absolutely need to get a joint sponsor since you no longer meet the criteria alone until you get a new job.

We never submitted any documentation at our AOS interview. We had everything, expecting we would be asked. We had not shown anything regarding income since the K1 interview in my husband's home country a year before (we waited a while before entering the US so a lot of time had passed). But all the IO asked for was my husband's current address and then the "yes/no" questions about felonies, terrorism, etc. The IO never asked for any proof of anything at all and we didn't show any proof of income. This may not be normal, but this was our experience.

OP I am so sorry this unexpected turn of events happened at this time. I wish I had word of advice but I completely empathize with you!

Exactly how our interview went. They said they just ask for that stuff in case something is missing from their files. I complained they didnt look at anything

I suspect its going to be much more likely they will ask about current employment status in any interview once they reopen, purely because they know so many people have been laid off.

I was thinking about this same question as well...I’m still working here in NY but I know it’s just a matter of time before we are shut down since we are considered non essential...it concerns me that I’ll be forced to take unemployment until we are able to return to work. I know that I’ll be able to back to my job as soon as restrictions get lifted.
