When can I apply for a i-751 waiver as a divorce, marriage were entered in good faith. I got my permanent resident card 12/11/2019 my husband told me 1 week ago he doesn’t love me and wants a divorce.

i want to fly back home on August can I apply anytime now because I can’t stay here for another 18 months. 😔

when can I apply for i-751 waiver anytime after I got divorce decree?

i just can’t stay with them more than august, does that means I just fly home and never come back?

I would wait until either I had the final divorce decree or when the 90 day window opens...I would certainly file before expiration of the GC...If you file before having the divorce decree, you will receive an RFE requesting it.  Either way, be prepared to provide evidence that the marriage was entered in good faith.....

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

EDIT:  To clarify, yes, you can file as soon as you receive the final divorce decree.

Flying back this year will  not be a problem, well coming back in will not be as you will have your GC and seems you have enough time to finalise the Divorce before filing, I assume you want to stay in the US but could read your comments the other way.

As I understand even if I apply for i-751 as marriage in good faith if I move back home and stay for 2 years even if I get 10 y green card I will be refused, because I am not residing in USA? Right!

so I need to file to give up my residency to be out of here clean and come as travel on ESTA!

Sure if you want to leave, I would do it after you have gone, file the I 407 relinquishing your GC.

What should I do I recently got my permanent resident card, but after 3 months my husband US citizen told me he doesn’t love me and wants divorce. I want to go home and give up my permanent residency and leave, so everything would be ok, so USCIS would understand that I don’t need 2 year timeline anymore to file for removing conditions of my permanent residency, I know I can file form i-407, but how to make officers understand that marriage ended too so they don’t expect anything anymore and case would be closed and I wouldn’t get some ban of 10 yrs or something.

please help!

Do you still want to have the greencard? If yes, divorce and file I-751 immidiately after you receive your divorce decree.

A few options:

You can leave and file the I-407 back in Latvia. 

If you wanted to stay you can file ROC anytime on your own with a divorce waiver.   

Another option is to get a re-entry permit by filing an I-131 and then you would have upto two years to come back to the US.

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed
