Yes, you need a lawyer. Although it is highly unlikely to happen, technically they can take away his green card for material omission (misrepresentation) on the DS260, remember he signed that all facts are true with a long warning about the consequences of providing false or misleading information.

This isn't what you need to focus on right now.   It is going to be years, if ever she can come.

This is what you need.    You erred on the I-130 and he erred on the DS-260 and at the interview.  All under oath.

The child should have been mentioned on the petition. That said, it's not that uncommon for a child to be mistakenly not listed on it...it can be resolved later.

Also not listing the child on the DS-260 begins to look like hiding things.

Not listing the child yet again for ROC really looks like hiding it.

 

If support for the child has not been occurring, that can be a cause for denial of the N-400 by itself via the GMC requirement.

 

I concur - get a lawyer. You risk raising attention to something that could (not necessarily will) get your status revoked and deported. Don't dig a hole even bigger....get help.

I do understand it! Will it cause a problem in case we go/enter outside the US?

Very likely will if they revoke his green card for misrepresentation... he won’t be able to enter the country on any visa for a very long time if ever... hence why you need a lawyer

Tbh dont even touch the N-400 without a good lawyer.  It may not be worth ever thinking about since you two have lied about his child on the last 2 petitions and the visa application.

How old is the child?

As a parent I would think this goes beyond just “don’t touch the form”. Is living in the US more important to your husband than being with his child again? These are the kinds of really horrible choices you guys set up when you decided to lie on the applications. Sorry for being harsh, but the forms are clear to list all children, no exceptions.

Correct, if the daughter ever wants to come to the US in any capacity this will be picked up. Trying to continue hiding it just isn’t an option. They need a lawyer, and they need to fix it.
