Perhaps this question has been asked and answered elsewhere on the boards, but I couldn't find anything by searching.

Just received my NOA2 and we're prepping all of our AOS documents.  I just went to the USCIS site to download the most recent i864 form, and was greeted with this message:

image.png.ba52bf7704c4d890d522a4f55b539d4b.png

I understand what the message is saying, however, it is confusing me in a couple regards:

  • If we are uploading our forms to CEAC, we aren't actually sending them to USCIS, correct?  If correct, will the NVC/Embassy accept our forms if we use the old ones?
  • If I submit an "old" form via CEAC, does it need to be before the cutoff date that USCIS is describing above?

If anybody has any guidance to offer on this, it is much appreciated.

Apologies if this has been asked elsewhere.  Please link me and I'll be happy to shut my trap.

Thanks.

Thanks for the heads up!

This is super confusing. They don't even have the new edition of the form ready even though the final acceptance date is less than 20 days away.

Agreed. I'm curious as to where the new form is as well. I'd like to get a head start on filling it out as I have travel coming up and might be submitting documents while out of the country...

I'm wondering this too. We'll likely be getting our case number around the 15th so we'll be right in the middle of it and it is not clear at all what will change, if anything.

I am not a lawyer and nothing I say is or should be taken as legal advice.

Yep, that would be me 😞

@TJL - I asked the same question,  see below

what that means, is that you can use those i-864EZ forms until Oct 14. If I was you, I would wrap things up before that. Good luck

Would this rule apply to those waiting for an interview? The public charge information that is out there is very vague and leaves a lot of questions unanswered.

Therefore it will be at the discretion of the embassy to apply 250% requirement of the affidavit?

Certainly not.

Where are you getting 250% requirement.

I really wish we could see the new version of form.

NVC and Consulates are Dept. of State.  USCIS is Dept. of Homeland Security.  "We will accept..." applies to USCIS.  USCIS does not issue visas.  Submit the correct form.  The current rules for decision making will be applied to each decision.  You don't get different rules, simply because you submitted the old form before October 15.

A Warning to Green Card Holders About Voting

Hi Folks!  Just an update on this.

Looks like NVC isn't going to get to my case until after the 15th of October - thus requiring the new i864.

Went to the USCIS site today and found both old and new forms are available:

image.png.d773054593bf89be4d3be2d95a73a50f.png

I downloaded the new form and, other than the expiration date and form date, I cannot seem to find a single different line of text or question.

Does anybody notice anything different?

Thanks.
