Hi guys. Quick question, I am a bit confused here. So i am gathering our docs to file for ROC, I received few days ago a letter from USCIS...a reminder that my conditional would expire. It said also on the letter that I have to submit a copy of the Green Card of any children who received conditional permanent status under my marriage. Now my question is, should we include my 2 children, knowing that their GC is not expiring until 2020? Because they followed to join under K2 visa a year later after me. I don't want our case to be rejected because the kids GC expiration date is not up yet. What do you think?

On the i751 form page 3 it will ask you give  the info of all the children. Please fill it out.

Send front and back copies of green card for all the children along with the application. You will be good. All the best.

Thanks!! Does that mean, when the kids GC will be up to renew I’ll still have to remove conditions on their cards?

If You Are Not, or Cannot Be, Included in Your Parent’s Petition

You are going to have to file your own petition to remove the conditions on your permanent resident if you became a conditional permanent resident more than 90 days after your parent did. Also, you can file your own petition if you became a conditional permanent resident before that but for some reason your parent doesn’t file his or her own petition or doesn’t include you on that petition.

Hope this helps

My GC expires in the end of September, but we just mailed out our I-751 package last week 😅 Here’s our timeline so far.

- Dropped off our package at UPS: Tuesday, 08/13

- Package delivered at USCIS Dallas, TX: Wednesday, 08/14

- Received text with case number: Friday, 08/16

- Check cashed: Monday, 08/18

- Received extension letter for 18 months: Monday, 08/18

I’m so glad to see everything is going smoothly and fast (so far). Now comes the waiting game. Good luck to everyone! 😆

Including them means pay also for them correct? Instead of 1x1 the amount to pay, i

should make the check 1x3?. Sorry if I sound silly, just trying to understand Loool.

Hi, I don't think your children will be able to apply with you to remove the conditions but you will list all of them in part 5 as your children. According to the I-751 instructions, "If you have dependent children who did not acquire conditional resident status on the same day as you or within 90 days thereafter....,then those dependent children must each file Form I-751 separately to have the conditions on their status removed." (Who May File Form I-751? pg.1).

Your children acquired their conditional green card a year after you, they will need to file their own I-751separately based on the instructions tho. If your children acquired their GC same day as you or 90 days after, then they do not need to pay for the I-751. You will just list them in part 5 and check off the box that they will be applying with you.

Your children will have to apply within 90 days of  their green card expiry. If you have 2 children you fill out 2 i751 forms and 2 checks. You cannot apply before 90 days that's an automatic rejection.

Its different in all the states. In orlando you get 5 years even if your green card expires in 6months.In texas my friend told me that they called homeland before they issued his.Why dont you get your passport attested at the immigration office with the ROC extension letter.Hope that works .
